This session presents the most recent major developments involving the NLRB and higher education, and will focus on the following topics: the Northwestern University decision involving college athletes; the Board’s exercise of jurisdiction over colleges and universities with religious affiliations; the Board’s revised test under the Supreme Court’s decision in Yeshiva University, for determining whether full-time tenure track faculty are managerial employees; the Board’s recent decision in Columbia University involving the employee status of graduate students for the purpose of collective bargaining; recent cases dealing with adjunct professors; and recent decisions of importance involving bargaining units in higher education.
