Municipalities of all types and sizes in Pennsylvania are finding it more and more difficult to balance their budgets each year and to pay their long-term obligations such as pensions and post-retirement benefits. Some municipalities face a downward spiral of continuing deficits and unpaid obligations, and they find it necessary to enter the Commonwealth’s program for distressed municipalities under Act 47 of 1987, which is administered by the Department of Community and Economic Development. This session reviews the legal challenges that commonly confront distressed municipalities, and it reviews how the Act 47 process and Chapter 9 bankruptcy work.
