Every lawyer who presents a Motion to Suppress or argues that the other side has not ‘met its burden’ is taking part in the continuing story of the Constitution. But how many lawyers know how the Constitution came about? This course delves into the stories of the events and personalities, as well as the different ideologies and philosophies, that brought about the Constitution.

This historical review will give all lawyers the opportunity to truly get to know the document that is the beginning and end of all legal activity in the U.S. Whether you practice Civil or Criminal; whether you are defending a client charged with a traffic ticket in traffic court or a multi-million-dollar corporation in front of the U.S. Supreme Court, the Constitution is your one indispensable document.

We will follow the improbable story of our U.S. Constitution from the first arguments made by Boston lawyer James Otis about government searches; through the difficult months of debate that took place at the Convention in Philadelphia; along the tortuous path to ratification; and through the first years of implementation, years which gave flesh and blood to a vague and broad framework.

  • The Articles of Confederation
  • Learn how the ingrained distrust of central government brought about the Articles and why it was ultimately determined by some, though not all, that we needed to put together a Constitution “in order to form a more perfect union.”
  • The Making of the Constitution
    • Hear how the Constitutional Convention came about
    • Learn how our system of checks and balances, federalism and the Presidency was created
    • The Amendments
    • The Bill of Rights
    • The Ratification Process
  • Constitutional Interpretation
    • From the beginning there have been heated debates about what it means
    • Discuss how these concepts apply to us today
