Fear and Loathing in Litigation:  How to Avoid Pitfalls and Secure the Best Result for Your Client

Law school did not teach you all of the potential pitfalls that you may encounter when litigating a case.  In this interactive program, the panel will share and invite you to participate in discussing strategies for avoiding those pitfalls and even coming out ahead in spite of them. 

Learn the “tricks of the trade” for:

  • Steering clear of unacceptable litigation tactics
  • Managing witnesses and evidence 
  • Discovery and motion practice tactics (what works and what backfires)
  • Posturing a case in mediation (what works and what doesn’t)
  • Negotiating with the adversary (what works and what can be bad faith) 
  • Handling the case which turns on legal issues (both before and on appeal)
  • Bonus: Get a peek at how judges view attorney actions, what they see as effective and what they see as offensive

Capacity, Competency and Ethical Interventions

Our legal system endorses the principle that all persons are competent to make reasoned decisions unless demonstrated to be otherwise. What happens when an individual's ability to understand information or to make decisions becomes impaired? 

Attorney Roxane Crowley engages you in a dialogue to explore:

  • Guardianship -- requirements, roles, and responsibilities 
  • Ethical dilemmas in representing a client with diminished capacity
  • Who is the client? An ethical roadmap to determining if you are advocate for the client with diminished capacity or for the family member petitioning for guardianship.
