Pennsylvania passed the Contractor and Subcontractor Payment Act (“CASPA”) in 1994, and the prompt payment provisions of the Commonwealth Procurement Code in 1998, to equalize the playing field between owners, contractors and subcontractors regarding payment for work on construction projects in the state.  Important clarifications were passed to CASPA in 2018, I hgwhich included formalizing a right to suspend work for nonpayment, new retainage requirements and details on steps to take when payments will be withheld.  This seminar will discuss the statute, the 2018 amendments, and current case law developments under both the public and private acts.
