Amendment to Rule 229 Governing Discontinuance of a Civil Action

An amendment to Pennsylvania Rule of Civil Procedure 229 clarifies which parties may seek leave of court to discontinue a civil action as to less than all defendants. Under the revised rule, available here, leave of court may be sought by any plaintiff or any defendant for whom the plaintiff has stipulated in writing to the discontinuance. Per the Pennsylvania Supreme Court’s order, the amendment is effective April 8, 2015. The Civil Procedural Rules Committee has published an Explanatory Comment.
