The standard for pleading and proving bad faith was addressed by the Pennsylvania Supreme Court in its recent decision in "Rancosky v. Washington National Insurance Company," No. 28 WAP 2016 (Pa. Sept. 28, 2017). Evidentiary requirements relative to an insurer’s alleged “subjective motive of self-interest or ill-will“ will be specifically addressed. This course will also address implications for pleading, discovery and trial presentation. Other topics involving bad faith will include issues involving common law claims, affirmative disclosures, impact of insurance appraisals and discovery and evidentiary trends.
