Representing a client with diminished capacity frequently occurs in estate and elder law practice. Join us for a discussion about evaluation capacity, including what the lawyers role is and the conditions that affect mental capacity. We will also discuss engagement and compensation concerns for lawyers representing a potentially incapacitated client. What are the risks involved for the lawyer? What is the nature of the legal services that the incapacitated person is looking for? Take away practical tips from practitioners, a judge and a doctor to help you understand how best to represent a client with diminished capacity.
