A discussion regarding the failing of traditional malls in America, including its causes, trends in redevelopment plans (from Mega Churches to Experiential Entertainment and Lifestyle Centers), actions of local governments, developers, and retailers, and the role of the real estate lawyer in the overhaul and redevelopment process.

Small Fish; Big Pond – Issues Facing Small Retail Tenants and How to Get the Best Possible Lease When You Are Not the Biggest Fish in the Pond - Giuseppina McCarthy, Esq. & Rhonda M. Weaver, Esq.
The course will highlight those lease issues most important to small retail tenants and will provide tips on how these tenants can negotiate the best possible lease terms even when they are not the biggest tenant in the center.

Confessions of Judgment – The Good, The Bad and The Ugly - H. Jeffrey Brahin, Esq.
A comprehensive review of judgments by confessions including the drafting and negotiating of the cognovit clause, taking and executing on the judgement; petitions to strike and open the judgement, and appeals.  Practical strategies will be discussed regarding negotiations, notices to be filed, discovery, stays of execution, etc.  Forms included.

I Am Begging You - Don’t Look Like an Idiot on The Web – Jennifer L. Ellis, JD
During this entertaining session the faculty will explore occasions when attorneys engaged in conduct that got them negative attention through the web. Ms. Ellis will discuss these incidents in concert with the ethics rules and also explore the public relations impact that bad behavior which goes viral can have on a legal practice. The Faculty will also explore ethically appropriate ways to use social media and other online tools for publicizing your firm.

Commercial Purchase Agreements Basics - John P. Schwartz, Esq. and David B. Lipner, Esq.
This session will cover the basics of negotiating a commercial real estate purchase and sale agreement.  The session will start with a discussion of the ancillary agreements useful during the PSA negotiation stage.  Next, due diligence issues to be considered will be covered.  Finally, the presenters will provide an overview of the general critical issues that practitioners should be wary of.

Title Insurance – Effective Use of Endorsements - Kenneth J. Yarsky II, Esq. & Lisa A. McEntee, Esq. CLTP 
Understanding all available approved endorsements and how they differ from ALTA Endorsement.  Use of approved endorsements in negotiating coverages for Lenders and Owners/Leaseholders.  Which endorsements should be required by a Lender, and why, in connection with the issuance of a Loan Policy and which endorsements should Owners/Leaseholders be recommended to secure, weighing cost/benefit and Underwriter requirements to issue endorsements beyond payment of the requisite premium.
