Overview

Understanding the myriad of ethics issues that arise in the day-to-day workings of a law firm is more complicated than you might think. And perhaps there is no area of the business of law practice that is more complicated than the concepts surrounding marketing, advertising, solicitation, and business development. What are the relevant Rules of Professional Conduct? Which state bars regulate my practice? What safeguards does your law firm take to ensure compliance with the RPC and avoid a letter from the disciplinary board, or a malpractice claim from a client?

This three-hour ethics CLE provides an in-depth overview of the many tools attorneys are using today for business generation, and the ABA and state bar ethics opinions, court decisions and rules that relate to areas such as digital marketing and social media, trade names, public relations, lead generation, ratings and rankings, responding to online reviews, and many other relevant topics.

  • Overview of law marketing ethics issues, dating back to Bates v Arizona in 1977

Faculty

Micah Buchdahl Esq.

Mr. Buchdahl is an attorney focused on assisting law firms with business development initiatives. He is Chair of the American Bar Association’s Standing Committee on Continuing Legal Education and a past chair of the ABA’s Law Practice Division. He also serves on the ABA’s New Membership Model implementation committee. Mr. Buchdahl is a faculty member of the Pennsylvania Bar Institute, where he has taught ethics courses on marketing and the Internet for nearly 20 years. Based in Moorestown, New Jersey, he is president of HTMLawyers, Inc., a law marketing consultancy. Mr. Buchdahl draws vision and ideas from a well of career experience. He worked in the Philadelphia Municipal Court as a mediator and arbitrator. Mr. Buchdahl was formerly associate corporate counsel with the Philadelphia Flyers and Spectacor, as well as director of NBA Photos, a marketing division of the National Basketball Association. For five years, he worked for a legal industry vendor on the sale and development of law marketing products and services. Mr. Buchdahl is well known for his ethics counsel as it pertains to law marketing and advertising issues and compliance. With HTMLawyers, founded in 2001, he has worked with law firms of all shapes and sizes on initiatives ranging from business development planning to audits of existing marketing efforts. An active ABA member, Mr. Buchdahl is the marketing columnist for Law Practice magazine. He is a past editor in chief of the ABA’s Law Practice Today webzine, where he now serves as Associate Editor. Mr. Buchdahl blogs on law marketing topics at www.MarketingAttorney.com. Prior to law school, he worked in marketing and public relations functions within the National Hockey League and Major Indoor Soccer League. Mr. Buchdahl also served as a journalist for The Baltimore Sun. He attended Temple University both as an undergraduate (B.A., journalism, magna cum laude, 1985) and later for Law School (J.D., Dean’s List, class president, 1991). Mr. Buchdahl is admitted to the Pennsylvania Bar.

Thomas Spahn Esq.

Mr. Spahn practices as a commercial litigator. He regularly advises Fortune 500 companies on such high-stakes issues as properly creating and preserving the attorney-client privilege and work product protections when conducting corporate investigations, when hiring outside consultants, when dealing with the government, and during other daily and extraordinary situations. He also advises in-house counsel on ethics issues, including conflict of interest, confidentiality, and dealing with corporate wrongdoing.
