Registered and unregistered trade dress and design patents are increasingly used to protect a variety of non-utilitarian assets, from product configurations to design elements.  This one-hour session compares and contrasts U.S. protection by trade dress and design patents from application through enforcement.

Jacqueline Lesser Esq.

Ms. Lesser is a partner in the Intellectual Property group at Ice Miller, LLP.  Based in Philadelphia, Ms. Lesser is ranked among the leading U.S. trademark professionals.  She litigates trademark and trade dress disputes U.S. federal courts and the Trademark Trial and Appeal Board (“TTAB”).  In addition to her litigation practice, she has handled U.S. and global brand enforcement for a range of companies, and  provides counsel on all aspects of U.S. and international trademark protection, from clearance to procurement, licensing and distribution. Ms. Lesser received her B.A., cum laude, from the University of Massachusetts and her J.D. from Brooklyn Law School. She is a member of the Pennsylvania and New York bars, the Philadelphia Bar Association, the Copyright Society of the U.S.A. and the International Trademark Association, and ECTA. Ms. Lesser is admitted to practice before the U.S. Supreme Court; the U.S. Court of Appeals for the Third, Seventh and Tenth and Federal Circuits; and the U.S. District Court for the Eastern and Middle Districts of Pennsylvania and the Eastern, Southern and Western Districts of New York

Holiday Banta Esq.

Registered Patent Attorney Holiday Banta possesses a sophisticated skill set as a result of her over 25 years of patent prosecution, intellectual property litigation, and transactional experience. She counsels clients ranging from Fortune 100 companies to start-ups on how to build and protect their patent and trademark portfolios in the U.S. and around the world. Her extensive litigation history allows her to help clients prosecute and defend business disputes concerning their intellectual property. She has represented clients as both plaintiffs and defendants in approximately 65 federal court cases and more than 65 matters before the TTAB. Holly handles utility and design patent prosecution for clients in a wide range of fields, including the biotechnology, agriculture, chemical, automotive, manufacturing, pharmaceutical, equine, wireless technology, motorsports, powersports, insurance, consumer goods, real estate, food service, power generation, and publishing fields. Holly assists companies to develop in-house intellectual property protection programs and recommends and implements protection strategies for core intellectual property assets. Client needs come first in Holly’s practice, and responsiveness is key to satisfying those needs. Holly takes the time early on to learn about each client’s unique perspective and values to ensure that her advice and analysis are tailored to fit. Calls and emails are answered promptly, and, whenever possible, work is performed proactively to maximize value and efficiency for the client. She litigates matters with the same focus and tenacity required in her spare time pursuit of training thoroughbred racehorses to run and jump at speed.
