Overview

Cell phone evidence shows up in everything from divorce cases to homicides—and it’s easy to misuse. This 90 minute program demystifies common data types (CSLI, extractions, app data), explains the legal framework (subpoenas/warrants and beyond), and gives counsel on both sides concrete strategies for admissibility, reliability, and persuasion.

Learning Objectives (CLE-ready):

By the end, attendees will be able to:

  1. Identify the main categories of mobile evidence (CDRs/CSLI, handset extractions, location artifacts, app logs) and what each can—and cannot—prove.
  2. Explain the core legal standards for acquisition and admissibility (warrants/subpoenas, consent, scope, Daubert/Frye challenges).
  3. Spot and correct common reliability traps (UTC vs. local time, tower/sector misconceptions, timing advance limits, over-precision claims).
  4. Draft targeted requests and motions (preservation, narrow subpoenas, Rule 702 challenges; or, on defense, reliability/qualification attacks).
  5. Integrate cell data into case theory with simple visuals and cross-examination themes.

Faculty

Kevin R. Horan

Kevin R. Horan is a former FBI Special Agent and current digital-forensics consultant with more than twenty-five years of investigative and courtroom experience. He is the co-founder of Precision Cellular Analysis (PCA), a firm specializing in the forensic analysis of call detail records, mobile extractions, and location data for criminal and civil litigation nationwide.
During his FBI career, Mr. Horan served as a Cellular Analysis Survey Team (CAST) supervisor, working hundreds of complex investigations involving cellular records, GPS, and digital evidence. He has testified as an expert in both federal and state courts, and his work has been featured on Court TV, Dateline NBC, and Investigation Discovery.
Today, through PCA and his training company Courtroom Shield, Mr. Horan trains lawyers, investigators, and law enforcement officers on the proper collection, interpretation, and courtroom presentation of digital evidence. His programs emphasize practical strategy, clear communication, and scientific integrity in the use of cell phone data at trial.
