Overview

California, Colorado, Pennsylvania and New York (and several other states) have already issued guidance on the use of artificial intelligence by insurers. Additionally, some states have adopted their own versions of the NAIC’s 2023 model bulletin: “Use of Artificial Intelligence Systems by Insurers.” During this 60-minute CLE program, insurance industry experts will analyze the use of AI at several points in the insurance policy lifecycle, including underwriting, pricing and claims adjudication and will discuss the current regulatory landscape for the use of AI in the insurance industry, with the goal of helping the insurance industry navigate these unchartered legal waters.

Faculty

Kara P. Pike, Esq.

Mrs. Pike is a Partner at the Harrisburg office of Saul Ewing LLP, where she is a member of the firm’s Insurance Industry Group. She advises clients in the insurance industry on regulatory matters involving federal and state insurance laws. She currently serves as a member of the Dauphin County Bar Association and is a member of the Pennsylvania Bar Association, including the Insurance Staff Committee and the Administrative Law Committee. Before entering private practice, Mrs. Pike served as deputy general counsel in the Governor’s Office of General Counsel (OGC) as well as assistant deputy general counsel in the Legislative Group. She lectures on insurance regulatory issues and has published numerous articles on InsurTech and other current topics in insurance regulation. She earned her B.A. from American University and her J.D. from Widener University Commonwealth Law School, where she also recently served as an Adjunct Professor for Insurance Law.

Frederic Garsson, Esq.

Fred Garsson is a seasoned insurance and reinsurance regulatory attorney who concentrates his practice on advising insurance industry clients on matters involving U.S. federal and state insurance laws (focusing on New York) and sophisticated national and international regulatory matters. Fred has vast experience representing life, health, long-term care, and property/casualty insurers, reinsurers and insurance producers in corporate and regulatory matters, including holding company transactions compliance, and reinsurance and assumption transactions. He assists with organizing and licensing of insurance companies, insurance producers, reinsurance intermediaries and independent insurance adjusters. Fred also drafts and analyzes insurance policies, annuity contracts, reinsurance agreements and other complex contracts, including agency and brokerage agreements. In addition, Fred represents clients in connection with the regulatory aspects of sales and mergers and acquisitions of insurance and reinsurance companies. He also represents clients before numerous state insurance agencies, and he advises insurance industry clients with respect to corporate and insurance regulatory and compliance matters.

William Latza, Esq.

William Latza provides life and non-life insurance and reinsurance companies with regulatory advice and assistance, drawing upon his more than 40 years of experience in private practice for the insurance industry and as the now retired General Counsel-Insurance of Lemonade, an InsurTech insurance company. Having spent his entire career in New York, Bill is adept at helping clients navigate issues affecting their operations and business evolution with sophisticated insurance regulators in a state with some of the most stringent insurance regulatory requirements in the country. This includes counseling well-known insurance companies on the regulatory challenges they face when they develop new insurance programs, expand into new markets, change their organizational structure or face financial challenges, and then strategizing to help them achieve their goals in a fragmented, detailed and prescriptive regulatory environment. Through his work at Lemonade, Bill navigated the company though novel and evolving issues such as the use of artificial intelligence and algorithmic underwriting, and later he advised on regulatory and legal issues connected with its expansion and inward investments. Before he led Lemonade’s legal department, he served as external counsel to the then startup, and he was key in persuading New York regulatory authorities to grant the company its license to operate using an innovative technology platform that digitizes the entire insurance process. At Saul Ewing, Bill is focusing primarily on matters including reinsurance, statutory accounting and InsurTech. He also has extensive experience guiding insurance and reinsurance companies through the legal and regulatory requirements that arise in highly complex acquisitions and financially-motivated transactions. Additionally, he advises insurance groups on holding company and financial condition regulations, and issues arising with alternative and capital markets risk transfer. Bill also guides companies and boards of directors through the legal and regulatory hurdles they confront with discontinuing operations, operating in the zone of insolvency or other troubled-company situations.

Diana L. Sherman, CPA, CFE, CISA, CITP

Diana L. Sherman is a state official with the Pennsylvania Insurance Department. She is currently serving as the Acting Deputy Insurance Commissioner for the Office of Corporate and Financial Regulation. Based in Harrisburg, she has held roles involved in insurance company regulation and financial oversight.
