Overview

Contracts for senior living communities are unlike traditional residential agreements, blending elements of real estate, health care, consumer protection, and elder law. This CLE program provides attorneys with a comprehensive overview of the legal and practical issues that arise when advising older adults and their families on senior living contracts, including independent living, assisted living, memory care, and continuing care retirement communities (CCRCs). The program will examine common contractual provisions such as entrance fees, monthly service charges, levels of care, transfer and discharge rights, refund policies, arbitration clauses, and limitation-of-liability language. Faculty will also address regulatory frameworks governing senior living facilities, disclosure requirements, and the intersection of these contracts with Medicaid, long-term care insurance, and estate planning considerations. Through real-world examples and practice tips, this program will help attorneys identify red flags, negotiate key terms, and counsel clients on aligning senior living contracts with financial, health care, and long-term planning goals. Whether representing residents, families, or advising professionals in the aging space, attendees will leave better equipped to protect clients and navigate the complexities of senior living agreements.

Recorded in March 2026.
