Overview
Pets are family - but what happens when the law gets involved?
This course will examine the evolving legal treatment of pets in estate planning, family law, and other animal-related legal matters.
The program will begin with an exploration of pets in estate planning. For many clients, pets are valued members of the family, making it essential that these beloved companions are properly provided for in their estate planning documents. Attendees will learn about pet trusts, designated caregivers, care instructions, and other planning tools that can be incorporated into an estate plan to ensure a client's pet is cared for and its needs are met without interruption in the event of an unexpected circumstance.
Next our panel will explore how pets are treated in family law, including the treatment of pets in custody and divorce matters. Particular attention will be given to recent provisions added to Pennsylvania's Protection From Abuse Act addressing companion animals, including the applicable standard for seeking relief. Relevant case law, drafting considerations, and practical strategies for negotiation and advocacy will be discussed.
Our panel will also discuss the legal distinctions and rights attributed to service assistance dogs, trained therapy animals and emotional support animals under including the rights and protections afforded under applicable federal and Pennsylvania law. The discussion will highlight important distinctions that attorneys should understand when advising clients regarding housing, access, accommodations, and other legal issues involving animals.
Finally, stay current on emerging animal welfare and animal cruelty legislation and the legal developments practitioners should have on their radar.
This program is presented in collaboration with Animal Friends.
