Purdue Pharma – What Next?
An interactive discussion of the Purdue Pharma decision and its effect on Chapter 11 cases and plans. The panel will discuss the logistics for obtaining third party releases as well as additional/collateral issues raised by the Purdue Pharma decision on topics such as extensions of the automatic stay to third parties and what types of release, injunction and exculpation provisions will be permissible on a going forward basis.

Larry J. Kotler, Esq.
Lawrence J. Kotler is a Partner at Duane Morris in Philadelphia and co-chair of the Bankruptcy and Fiduciary Representations division of Duane Morris’ Business Reorganization and Financial Restructuring Practice Group. Mr. Kotler practices in the area of reorganization and finance, representing chapter 11 debtors-in-possession, chapter 11 trustees, chapter 7 trustees, liquidating trustees, creditors’ committees, secured creditors and large institutional unsecured creditors in all facets of bankruptcy. Mr. Kotler is currently serving as counsel to the senior secured lender in the Hajjar Business Holdings, LLC et al, bankruptcy cases, pending in the United States Bankruptcy Court for the District of New Jersey; counsel for StoneMor Operating LLC in the bankruptcy cases of Moon Group, Inc., pending in the United States Bankruptcy Court for the District of Delaware; and trustee’s counsel in the bankruptcy cases of Image Masters, Inc., et al., Fitzpatrick Container Corp., Precise Graphix, LLC, WM Robots, LLC, and The Swarthmore Group, LLC, all pending in the United States Bankruptcy Court for the Eastern District of Pennsylvania. Mr. Kotler has been listed in Chambers USA: America’s Leading Business Lawyers since 2006 as one of the top Bankruptcy lawyers in Pennsylvania. Hon. Thomas M. Horan
Hon. Thomas M. Horan is U.S. Bankruptcy Judge for the District of Delaware in Wilmington. He was appointed in 2023. He previously practiced law in Wilmington for 18 years, focusing on financial restructuring and bankruptcy litigation. Before joining the bench, he was a member of the Bankruptcy, Insolvency and Restructuring group at Cozen O’Connor in the firm’s Wilmington office. Judge Horan’s national practice included representing debtors and official unsecured creditor committees in complex chapter 11 proceedings, and he represented secured creditors and other parties in litigation. Judge Horan received his B.A. in 1989 and his M.A. in 1992 from Fordham University, and his J.D. cum laude from St. John’s University School of Law in 2002, where he was Executive Notes and Comments editor for the ABI Law Review.
Martha B. Chovanes, Esq.
Martha B. Chovanes is a partner at Fox Rothschild LLP in the Financial Restructuring and Bankruptcy Department. Ms. Chovanes practices in the area of business reorganization, representing chapter 11 creditors’ committees, debtors-in-possession, chapter 11 trustees, chapter 7 trustees, liquidating trustees, and unsecured creditors in all facets of bankruptcy. Her practice involves the representation of Chapter 11 Committees, Debtors, and Trustees. Martha was previously Chair of the Eastern District of Pennsylvania Bankruptcy Conference and is a member of the Eastern District of Pennsylvania Bankruptcy Conference Local Rules Committee.
Martha is admitted in the Commonwealth of Pennsylvania and the State of New Jersey, the District Courts for the Eastern District of Pennsylvania, the District of New Jersey and the District of Colorado and is admitted to the Court of Appeals for the Third Circuit.
Adam H. Isenberg, Esq.
Adam H. Isenberg is a partner in Saul Ewing’s Bankruptcy and Restructuring Practice. He concentrates his practice in commercial bankruptcy matters and out-of-court workouts and has represented debtors-in-possession, creditors’ committees, trustees, secured creditors and other parties in cases throughout the country. Adam was one of the core group of attorneys at Saul Ewing who represented the debtors in the chapter 11 cases of Owens Corning et al., Lower Bucks Hospital, Hussey Copper, et al. and Associated Wholesalers, Inc., et al. Adam has written and spoken on various bankruptcy issues. He is a Fellow of the American College of Bankruptcy, and is a member of the American Bankruptcy Institute, the Turnaround Management Association, and the Bar Association of the Third Federal Circuit. He served for many years on the Steering Committee of the Eastern District of Pennsylvania Bankruptcy Conference and was Chairman of the Conference in 2006 and 2007.
