This program will provide a practical overview of the statutory and decisional requirements of the Sunshine Act along with recent and potential legislative updates to the law. The topics addressed will include, among others, what agencies and the committees of those agencies are/are not subject to the law, what is ‘deliberation’ or ‘official action’ that will trigger the law’s public mandates, what topics are/are not permissible to address in an executive session, what effects do virtual meetings have on the law’s requirements, interplay between RTKL and the Sunshine Act, the procedure for challenging an alleged violation, potential penalties and methods to cure violations, the ‘new’ agenda requirements, pending legislation and the parameters of public comment and the potential ramifications of attempts to ban or curtail public comment.
