Overview

Third party funding of patent litigation has become common, especially in the case of infringement actions brought by non-practicing entities (NPE’s).  Some courts have patent local rules requiring automatic disclosure of certain details of the funding arrangement. In other cases, discovery requests may call for such disclosure.  Third party funded plaintiffs have, in many cases, resisted disclosure, and the proceedings surrounding the call for disclosure have become contentious. We will examine some of these cases and how the courts have dealt with them.

Steven Rocci Esq.

Mr. Rocci is an experienced intellectual property lawyer whose 45+ years of technology and technology law experience includes over 40 years of law firm practice. Before entering the practice of law, he worked as an electronics technician and electronics engineer, and as a specialist in energy related regulatory affairs. Mr. Rocci began law firm practice in 1981 and has since practiced intellectual property law exclusively in national and AmLaw 100 firms. Since that time, he has amassed extensive experience in the areas of patent and trade secret litigation, intellectual property procurement, counseling, dispute resolution, and licensing. Today, he counsels clients in a wide variety of technological arts, including computer software and hardware technologies, internet and web technologies, database and data storage technologies, telecommunications technologies, semiconductor and semiconductor manufacturing technologies, business method and e–commerce technologies, medical device technologies, and various mechanical technologies. His client base has included major national and international technology companies, as well as start–up and mid–cap companies. Mr. Rocci taught law school courses in intellectual property law, and patent litigation and strategy, for nearly 25 years, and held the post of Distinguished Practice Professor of Intellectual Property Law at the Drexel University Thomas R. Kline School of Law in Philadelphia. He has also served as a neutral for the American Arbitration Association for disputes relating to intellectual property. Mr. Rocci is a former Fellow of the Litigation Counsel of America and is Av rated in Martindale Hubbell. Among other publications, he has been listed in Chambers USA Guide to America’s Leading Business Lawyers, The Best Lawyers in America, American Registry – America’s Most Honored Professionals, Legal 500 United States – Patent Litigation and The IP Lawyers – Recommended Attorney. He has been voted by his peers as one of Pennsylvania’s “Super Lawyers” in the area of intellectual property.
