Overview

This program provides an in-depth look at recent developments and practical applications of the Americans with Disabilities Act (ADA) as they relate to reasonable accommodations in the workplace. Attendees will gain a comprehensive understanding of current federal and state regulations, emerging case law, and enforcement trends from the EEOC. The course explores key issues including the interactive process, evolving definitions of “disability,” remote-work accommodations, mental health considerations, and balancing accommodation obligations with business operations. Through real-world examples, case studies, and discussion of best practices, participants will learn how to advise clients, evaluate accommodation requests, and minimize legal risk in managing employees with disabilities. The learning objectives of this course include: analyzing recent case law and EEOC guidance impacting reasonable accommodation obligations; understanding the employer’s duty to engage in the interactive process and document compliance; identifying effective strategies for addressing requests related to remote work, mental health, and medical conditions; and applying practical risk management techniques to reduce exposure to ADA-related claims.

Faculty

Rachel L. McElroy, Esq.

Rachel serves her clients using individually tailored and innovative strategies to best achieve their goals. She is a skilled litigator and has represented plaintiffs and defendants in both state and federal courts. She primarily focuses her practice on employment-related claims such as discrimination, harassment, and retaliation in the workplace. As your guide through the legal process, Rachel ensures that you receive prompt attention and compassionate representation throughout the course of your legal matter. Rachel is an active member of the Allegheny County Bar Association, the Western Pennsylvania Employment Lawyers Association (WPELA), SHRM, the Wendell G. Freeland Society, and the National Employment Lawyers Association (NELA). She serves as a member of the ACBA Judiciary Committee. She was the Past Chair of the ACBA Sole and Small Firm Practitioners Section and one of the first firms selected for the ACBA ALLY Initiative. She is on the NELA Amicus Advisory Council and has worked on various amicus briefs to assist the Third Circuit. She also serves as the Chair for WPELA. In 2021, 2022, 2023, 2024 and 2025 she was selected as a Super Lawyers Rising Star in Employment Law. Rachel earned her J.D., cum laude, from Case Western Reserve University School of Law. While in law school, Rachel served as Managing Editor for Journal of Law, Technology and the Internet and won a CALI Award for Excellence in Copyright Law. Rachel gained valuable experience while practicing at the Milton A. Kramer Law Clinic Center representing clients in various criminal matters, and serving as a research assistant for Professor Michael Benza.

Ashley L. Taragna, Esq.

Ashley Taragna is a Partner at Freeman Mathis & Gary, LLP and is located in the Philadelphia office. She is a member of the Labor & Employment and Commercial Litigation/D&O practice sections. Her practice focuses on defending clients in employment related matters and complex liability matters, including personal injury, catastrophic loss, and professional negligence claims. Ashley represents a broad range of clients, including professionals, businesses, and insurers, in litigation across Pennsylvania. She is known for her thorough case analysis and commitment to delivering strategic, cost-effective solutions. Her approach emphasizes clear communication and proactive case management, tailored to the unique needs of each client. She earned her J.D. from Widener University Delaware Law School in 2017 and holds a B.A. from Temple University. Ashley is a member of the Philadelphia Bar Association and the Philadelphia Association of Defense Counsel. Ashley currently serves on the Executive Committee of the Young Lawyer’s Division of the Philadelphia Bar Association. She also serves as a licensed Arbitrator for the Compulsory Arbitration Program of the Court of Common Pleas of Philadelphia County.

Brandon Lee Wolff, Esq.

Brandon Lee Wolff, Esq. represents and counsels individuals and businesses in matters involving business transactions, employment law, commercial litigation, estate litigation, estate administration, estate planning, real estate, bankruptcy, civil rights, disability law, health law, education law, family law and personal injury. Brandon is admitted to practice in Pennsylvania, New Jersey, New York, Florida and the District of Columbia. Brandon is the Past Treasurer of the American Bar Association Young Lawyers Division, Past Chair of the New York State Bar Association Young Lawyers Section, Past Chair of the New Jersey State Bar Association Young Lawyers Division, Past President of The Florida Bar Out-of-State Division, Past Secretary of the Pennsylvania Bar Association Young Lawyers Division and Past Governor on The Florida Bar Young Lawyers Division Board of Governors. In addition, Brandon is one of the most recent graduates on the Seton Hall Law Alumni Council and has co-chaired several committees. Brandon is also a co-chair of the Volunteer Lawyers for Justice Generation Now Committee. Brandon served as a law clerk to The Honorable Garry S. Rothstadt in the New Jersey Superior Court, Appellate Division. He also interned with three federal judges, the New Jersey Supreme Court and United States Attorney’s Office. Additionally, he was a Law Clerk at Summit Medical Group and Summit Health Management. Brandon received a Certificate in Healthcare Compliance and graduated cum laude (Top 11%) from Seton Hall Law with a Concentration in Health Law. He was the Editor-in-Chief of the Seton Hall Health Law Outlook, an Articles Editor of the Seton Hall Legislative Journal and a member of the school’s Appellate Advocacy Moot Court Board and Mock Trial Board. He participated in the school’s Impact Litigation Clinic, the Civil Rights & Constitutional Litigation Clinic, and the Southern District of New York’s Representation in Mediation Practicum. Before law school, Brandon was a National McCabe Scholar at Swarthmore College where he received the Deans’ Award for Sustained Contributions to the Swarthmore Community. Brandon was valedictorian of his high school class, founded an anti-violence organization and was recognized as the Prudential Spirit of Community Awards top high school volunteer in Pennsylvania.

Morgan M.J. Randle, Esq.

Morgan M.J. Randle is an Associate at Freeman Mathis & Gary, LLP and is located in the Pittsburgh office. She is a member of the Firm’s Labor & Employment practice section and actively participates in the Wage and Hour Interdisciplinary Team. Morgan brings a dynamic and globally informed perspective to her practice, shaped by her diverse heritage, extensive litigation experience, and ties to Japan, England, and China. Morgan represents private employers and public entities in employment litigation, guiding clients from pre-suit investigations and administrative proceedings (EEOC/PHRC) through trial. Her practice includes defending claims involving discrimination, retaliation, constructive discharge, leave interference, ERISA and FMLA violations, wrongful discharge, and whistleblower allegations. She has experience in both bench and jury trials and is skilled in responsive pleadings, discovery, depositions, dispositive motions, and trial advocacy. Morgan also advises companies on employment policies, manuals, contracts, and regulatory compliance. Morgan has both bench and jury trial experience. She is admitted to practice before the Supreme Court of Pennsylvania, all United States District Courts within Pennsylvania, the U.S. District Court for the Eastern District of Michigan, and the United States Court of Appeals for the Third Circuit. Morgan is an Arbitrator
and Mediator with the Allegheny County Housing Court Program and serves as a mentor in Penn State Law’s Mentor/Mentee Overview Program. She has spoken on labor policy changes, mental health leave, and judicial clerkships at FMG webinars and Penn State Law panels. Morgan earned her J.D. from Penn State Law, where she was a Jessup Moot Court Advocate and a coach for the National Criminal Procedure Moot Court. As part of her time at Penn State Law, Morgan was also admitted to the Order of Barristers for demonstrating exceptional trial and oral advocacy skills. She holds a B.A. in Political Science with an additional major in Japanese from Michigan State University.
