Overview

Anatomy of an Investigation will walk participants through the full lifecycle of a workplace investigation, beginning with how to define what qualifies as an investigation and when one may be required, including situations involving legal obligations such as Title VII. The program addresses key threshold decisions, including who should conduct the investigation - internal personnel, an external investigator, or employment counsel - and how to define the investigation’s scope while avoiding scope creep if additional issues arise.

The course also covers practical investigation mechanics, including how to select witnesses, determine the order of interviews, and decide whether measures such as paid leave are appropriate. It emphasizes interview essentials such as providing admonitions, preparing outlines, using supporting documentation, and asking open-ended closing questions. A significant portion of the program focuses on assessing credibility, handling “he said/she said” scenarios, and reviewing documentation carefully, including the need to watch for manufactured or doctored evidence, AI-generated materials, deepfakes, emails, messages, recordings, videos, and notes.

Finally, the program explains how investigators should reach and document conclusions using the preponderance-of-the-evidence standard, ensuring that conclusions remain aligned with the defined scope and are stated as either substantiated or not substantiated. It also addresses whether investigators should make recommendations for discipline or other action, outlines the essentials of report writing, and discusses post-investigation follow-up, including retaliation monitoring. The ethics component uses live polls to explore jurisdictional issues, represented complainants, recording, privilege, interviewing minors, and the investigator’s role in decision-making, before concluding with wrap-up and Q&A.

With a unique background as a labor and employment attorney with leading national law firms in California and Pennsylvania, and as a top human resources executive in numerous industries, he views client situations and solutions with a different and more holistic perspective. His passion is building and maintaining a “Respectful Workplace” platform through practical leadership education, clear and consistent communication, and creating a workplace culture built on the guiding principles of Respect, Trust, Honesty and Empathy. Keith received a B.A. in Labor and Industrial Relations from Penn State University and a J.D. from Villanova University School of Law.

Christina M. Reger, Esq.

Christina is the co-founder of Loutel Law, a certified WBE.
