It's the 29th Annual Elder Law Institute!

This two-day, in-person Elder Law Conference brings together leading practitioners and subject-matter experts to explore the legal, financial, and practical challenges facing older adults and the professionals who serve them. Designed for attorneys at all stages of practice, the program delivers timely updates, strategic insights, and practice-ready guidance across the full spectrum of elder law. Sessions will examine long-term care planning, Medicaid eligibility and benefits, Medicare updates and appeals, estate and incapacity planning, guardianship and alternatives, ethical issues, and emerging trends impacting aging clients and their families. Through substantive presentations, case studies, and interactive discussions, attendees will gain tools to better advise clients, manage risk, and adapt their practices to a rapidly evolving legal and regulatory landscape. The conference also provides valuable opportunities for in-person networking and collaboration with colleagues who share a commitment to serving older adults with competence, compassion, and professionalism.

Medicare Administrative Appeals and Emerging Topics

Eric Krupa is a supervising attorney at the Center for Medicare Advocacy. He primarily works to ensure that the Center is a dependable source of information, advocacy, and representation for individual Medicare beneficiaries in the state of Connecticut who are experiencing barriers to accessing their full Medicare benefits. Prior to joining the Center, Eric clerked for Superior Court Judge Peter A. Bogaard in New Jersey. He then worked as a fellowship attorney for Pine Tree Legal Assistance – Maine’s oldest and largest civil legal services provider – representing individuals in family law and protection from abuse matters. Eric was also a staff attorney with Connecticut Legal Rights Project, where he represented clients of Connecticut’s Department of Mental Health and Addiction Services in receiving adequate care and treatment. Eric graduated from Hunter College and Notre Dame Law School, where he developed a commitment to public interest law. He is licensed to practice law in Connecticut and Maine.

Prof. Pearson will host a panel of experts as we highlight concerns about quality of care and financial solvency for Senior Living operations, including Continuing Care Retirement Communities and Skilled Care Facilities. We will explore key recent developments, including the 2025-26 bankruptcy of a well-established (80 years!) senior care provider in Pennsylvania, involving 6 continuing care communities, two HUD properties, a home-care agency and a hospice company. Attorneys will want to hear the latest about accreditation standards, red flags – and tips - in order to help clients make more informed choices about long-term care providers.

Divorce, Dementia, and Disability: Spotting Legal Crossroads

When dementia or disability enters a family system, time-sensitive decisions about divorce, public benefits, and decision-making authority can determine whether a vulnerable person is protected-or unintentionally disqualified from critical support. This program provides an overview of foundational concepts in family law, guardianship, special needs planning, and elder law to help participants identify issues when capacity is in question, a marriage is strained, or public benefits may be needed. Using common fact patterns, the presenters will highlight red flags that should not be overlooked when these practice areas intersect.

Medicaid Planning with Annuities

In crisis Medicaid planning cases, little to no asset protection pre-planning has occurred but your client is nursing facility clinically eligible. You are often left with spend-down styled planning options. The basic goal of planning with annuities and notes is to convert available resources into a stream of payments defined as income by Medicaid. In this session, we will discuss what makes an annuity Medicaid compliant and cover planning scenarios with Medicaid compliant annuities.

Elder Law practitioners often face ethical dilemmas when representing seniors and individuals with special needs. Victoria L. White, PBA Ethics Counsel, will discuss many relevant ethical considerations including:

“Seniors, Scammers and Scoundrels” is an educational presentation designed to help communities understand why older adults are frequently targeted for fraud, scams, and financial exploitation. This program explores the factors that make seniors particularly vulnerable, identifies who is most likely to take advantage of them—including the often overlooked role of family members, caregivers, and trusted acquaintances—and examines the relationships that can place older adults at risk. Attendees will learn about common forms of fraud and financial exploitation affecting seniors today, from imposter scams and telemarketing schemes to misuse of authority, theft, and undue influence. Real world examples will help participants recognize red flags and understand how these schemes typically unfold. The presentation also highlights key resources, prevention strategies, and practical tools that families, professionals, and community members can use to help safeguard older adults. In addition, guidance will be provided on what steps to take and where to turn for assistance if someone has already been victimized. This program aims to empower individuals and communities to prevent exploitation, support victims, and better protect our senior population.

Crossing State Lines Can Cost You Everything: Medicaid, Elder Law and Estate Planning across 5 states (PA, NJ, DE, NY, FL)

Crossing state lines can have profound—and often unexpected—consequences for clients navigating Medicaid eligibility, long-term care planning, and probate/estate administration. This comprehensive CLE program examines the critical differences in Medicaid rules, elder law considerations, and estate planning strategies across five key jurisdictions: Pennsylvania, New Jersey, Delaware, New York, and Florida. Designed for attorneys who advise clients with multi-state ties, seasonal residences, or plans to relocate, this course will explore how variations in asset protection strategies, eligibility requirements, spousal protections, and estate recovery rules can dramatically impact planning outcomes. Faculty will highlight state-specific nuances, including differences in program eligibility requirements, levels of care covered under the Medicaid program, treatment of the homestead/primary residence, and the use of trusts and other planning tools and asset preservation strategies.
Through practical examples and comparative analysis, attendees will gain insight into common pitfalls that arise when clients move between states or own property in multiple jurisdictions. The program will also address coordination of powers of attorney, advance directives, and probate considerations across state lines. Participants will leave with a clearer understanding of how to proactively structure plans that remain effective despite geographic changes—and how to avoid costly missteps that could jeopardize a client’s eligibility for benefits or undermine an otherwise sound estate plan.

Tip of the Spear: Protecting the Legal Rights of the Alleged Incapacitated Person as Court-Appointed Counsel

This presentation will discuss the representation of an alleged incapacitated person by court-appointed counsel from the time of the appointment, including representation in emergency and plenary guardianship hearings, review hearings, appeals, and post-appointment petitions for allowance and the private sale of real estate. Ethical considerations, scope and duration of the representation, and fee petitions will also be highlighted.

Anthony L. Marone, Esq.

Attorney Marone is senior counsel in the Estate Planning and Elder Law firm of Gerhard and Gerhard, P.C., and has extensive experience representing elderly individuals and people with disabilities in a variety of matters involving Medical Assistance (Medicaid) benefits, wills and trusts, estate planning, guardianship, and Special Needs Trusts. He has pursued cases on behalf of his clients in a variety of forums including Orphans’ Court, Pennsylvania’s Commonwealth Court, federal court, as well as administrative hearings. He successfully litigated matters involving Medicaid Qualifying Annuities, Medicaid eligibility, the modification and termination of defective trusts, and the establishment, modification, and amendment of Special Needs Trusts. Mr. Marone began practicing law in 1994. After a lengthy military deployment, he joined the Office of General Counsel to the Governor of Pennsylvania in 2007. For seven years he represented various agencies of the Pennsylvania Department of Public Welfare and was the Department’s primary litigator and appellate attorney for both Medical Assistance long-term care and special needs trust issues in all the counties of eastern Pennsylvania. Mr. Marone left government service for private practice in 2014. He was a partner with McAndrews Law Offices focusing on elder law and special needs trust matters. He joined Harvey, Ballard, and Bornstein, L.L.C. as a partner in 2020, and then Gerhard and Gerhard, P.C.in 2025 to focus on complex Medicaid and special needs trust matters, including those that require guardianship. Attorney Marone is an active member of the Pennsylvania Association of Elder Law Attorneys (PAELA) and was named the 2023 PAELA Person of the Year and serves on the PAELA Board and Public Policy Committee. Mr. Marone is a lifelong resident of Philadelphia. He is retired from the military and is a veteran.

Linda M. Anderson is the founder and principal of Anderson Elder Law, a firm in Media, PA serving clients of all ages throughout the Delaware Valley. She is dedicated to helping individuals and families navigate legal, financial, and medical issues related to elder law, estate planning, and long-term care and special needs planning. Ms. Anderson has over 30 years of experience in the elder law field and is a Certified Elder Law Attorney, as conferred by the National Elder Law Foundation and authorized by the Pennsylvania Supreme Court. Ms. Anderson is an active and distinguished member of her evolving field. She is an accredited attorney with the Department of Veteran Affairs as well as a Charter Member of the Life Care Planning Law Firms Association, and long-time member of the National Academy of Elder Law Attorneys. Ms. Anderson is the past President of PAELA (Pennsylvania Association of Elder Law Attorneys (2018-2019)) and has served as Chair of the Pennsylvania Bar Association Elder Law Section (2009) and as Co-Chair of the Delaware County Bar Association’s Elder Law Committee (2004-2018). Ms. Anderson has been recognized as a Pennsylvania Super Lawyer® in the field of Elder Law since 2004, and repeatedly as one of the Top 100 Lawyers in Pennsylvania and as a Top 50 Women Lawyers in Pennsylvania. She was awarded with the 2012 PAELA Member of the Year Award and Anderson Elder Law has been distinguished by U.S. News and World Report as one of the top law firms in the country and she has been selected for Best Lawyers in America. Ms. Anderson also received the prestigious AV® rating from Martindale Hubbell and is a Fellow of ACTEC (The American College of Trust and Estate Counsel). Ms. Anderson was also honored for the 2022 Achieva Awards of Excellence in Legal Services by Achieva, a family of organizations that seeks to empower people with disabilities. Ms. Anderson not only volunteers with community and professional groups to share her knowledge, but is also a regular faculty member and course planner for the Pennsylvania Bar Association in areas of elder law, estate planning, long term care planning, special needs planning, and veterans’ benefits. She received her bachelor’s degree from Sarah Lawrence College, has a master’s degree in Taxation from Villanova University, and graduated from the University of San Francisco School of Law.

Tammy A. Weber, Esq., CELA

Ms. Weber is the managing principal of Marshall, Parker & Weber, LLC (www.paelderlaw.com) with offices in Williamsport, Plains, and Jersey Shore, Pennsylvania. Her practice focuses on elder law, estate and business succession planning. She graduated magna cum laude from Lycoming College and received her law degree from Temple University. She is a certified elder law attorney (CELA) by the National Elder Law Foundation. She is also a VA accredited attorney for the preparation, presentation, and prosecution of claims for veterans’ benefits before the Department of Veterans Affairs. She previously served as an Assistant United States Attorney for the Eastern District of Pennsylvania where she was involved with major federal investigations and prosecutions. While in this position, she was the recipient of the Department of Health & Human Services Inspector General’s Integrity Award for the investigation and criminal conviction of the first Medicare money laundering seizure case in the country. Ms. Weber has also served as an adjunct professor at Saint Joseph’s University Graduate Criminal Justice Program where she designed and taught a course on law and social policy. For several years, she sat on the editorial board of the Legal intelligencer. Ms. Weber is a Past President of the Pennsylvania Association of Elder Law Attorneys (“PAELA”), a Past Chair of the Pennsylvania Bar Association’s Elder Law Section and serves on Council, a Past Chair of the Lycoming Law Association’s Community Activities and Outreach Committee, and Past President of the Lycoming Law Association. Ms. Weber is Past Chair of the First Community Foundation Partnership of Pennsylvania (“FCFP”) and a Trustee and Chair of the Personnel Committee for Lycoming College, Williamsport PA. David Shallcross

In 2008 David joined the ranks of the Office of Attorney General as a Community Liaison in the Public Protection Division’s Elder Abuse Unit, He was later promoted to Senior Community Liaison and Coordinator of the Elder Abuse Unit and in 2017 he was appointed as the Acting Director of Education and Outreach. Currently he is the Director of the Senior Protection Unit under the Office of Public Engagement and is the Attorney Generals’ designee on the PA Supreme Court’s Elder Justice Advisory Council. Mr. Cameron has served as a member of PBA’s Legal Ethics and Professional Responsibility Committee since January 6, 2001.A sole practitioner in Harrisburg, his practice is focused on estate planning and estate administration.He has served as president of the Estate Planning Council of Central Pennsylvania, and Chair of the Estate Planning Section of the Dauphin County Bar Association.Prior to establishing his practice, Mr. Cameron served as judicial clerk for the Hon. Warren G. Morgan, then President Judge and Orphans’ Court Judge for Dauphin County.He earned his B.A., cum laude, from Dickinson College and his J.D. from the University of Baltimore School of Law, where he served as Associate Comments Editor of the Law Review.Prior to law school, he had been employed as a bank trust officer.

Victoria L. White, Esq.

Ms. White is currently Ethics Counsel to the Pennsylvania Bar Association. As Ethics Counsel, Ms. White responds to Ethics Hotline inquiries from PBA members who have questions concerning the impact of the provisions of the Pennsylvania Rules of Professional Conduct upon their own prospective conduct. Ms. White also assists the PBA’s Legal Ethics and Professional Responsibility Committee, which issues written ethics opinions and reviews and recommends proposals for changes to the Pennsylvania Rules of Professional Conduct. In addition to staffing the Ethics Committee, Ms. White is the staff liaison to the PBA Civility in the Profession Committee. She also serves as the Associate Editor of the Pennsylvania Ethics Handbook, a useful guide to the professional responsibility obligations of practicing Pennsylvania lawyers. Prior to joining the PBA, Ms. White served as Assistant Counsel for the Commonwealth of Pennsylvania State Ethics Commission, practiced for several years in the private sector, and was a staff attorney in the solicitor’s office for a local municipality. Ms. White received her B.A. from Franklin & Marshall College and her J.D. from American University, Washington College of Law.
