Overview

The rise in healthcare bankruptcies presents new issues in a restructuring or value-maximizing sale.  This panel will discuss some of these emerging issues, including:

  • Characterization of leases in residential care facilities;
  • State laws aimed at preventing hospital bankruptcies;
  • The rise of investor-led models for healthcare real estate ownership, and the resulting challenges for bankruptcy asset sales;
  • Novel plan provisions channeling personal injury claims;
  • Successor liability after a sale or reorganization.

Faculty

Turner N. Falk, Esq.

As a member of the firm’s Bankruptcy and Restructuring Practice, Turner Falk assists debtors, creditors and committees in bankruptcy and adversary proceedings. He has experience working on Chapter 11 reorganization cases, liquidations and bankruptcy confirmations, and representing multi-district litigation mass tort class creditors.
Before Turner worked in private practice, he was a law clerk for the Honorable Eric L. Frank in the U.S. Bankruptcy Court for the Eastern District of Pennsylvania.

Jason Angelo, Esq.

Jason is counsel in Reed Smith’s Financial Industry Group, practicing in the areas of Restructuring & Insolvency and Commercial Litigation, including related appellate work. Jason’s diverse practice includes advising a variety of constituents in complex business reorganizations and insolvency matters, including debtors, secured creditors, creditor committees, equity holders, parties to preference and fraudulent transfer disputes, and other key stakeholders. Jason also has substantial experience representing and advising indenture trustees and other fiduciaries in the corporate trust space. He has been recognized as a Rising Star in the restructuring and insolvency community by the IFLR1000 (2022 – 2023), was selected as part of the “NextGen” Program (2021) sponsored by the American College of Bankruptcy and the National Conference of Bankruptcy Judges, and participated in the 2022 Pathfinder Program with the Leadership Counsel on Legal Diversity. Jason is a 2013 graduate (cum laude) of Seton Hall University School of Law and a 2010 graduate (cum laude) of the University of Delaware. He was the Editor-in-Chief of the Seton Hall Legislative Journal and a winner of Seton Hall’s Congressman Peter W. Rodino, Jr. Award for Leadership, Service, and Humanitarianism. Upon graduating from law school, Jason served as a law clerk to the Honorable Marie P. Simonelli of the New Jersey Superior Court—Appellate Division. Jason currently serves on the Delaware State Bar Association’s DE&I Steering Committee, is a member of the Board of Directors of the Philadelphia LGBTQ+ Bar Association, and previously chaired the Delaware State Bar Association’s LGBTQ+ Committee for a number years. He also has been a Co-Chair of Reed Smith’s Global LGBTQ+ Business Inclusion Group, PRISM, since 2019, and was an inaugural member of the Diverse Alumni of Seton Hall (DASH) Committee. A Delaware native, Jason volunteers with the Delaware Office of the Child Advocate, Delaware Volunteer Legal Services, and the ACLU of Delaware.
