Jennifer Ellis & Richard Holzworth

Generative AI can now produce video of a person who does not exist, speaking and behaving on command. This plenary opens with a demonstration. Attendees will watch a remote will execution conducted over video conference, with an attorney, a notary, and a testator who was generated entirely by AI, along with his identification. The presenters will then show how the video was made and how long it took.

The program turns from there to the legal consequences. It covers how a fabricated execution would be challenged, what a will contest looks like when the disputed evidence is a recording everyone believed at the time, and where Pennsylvania law currently stands on remote execution. It closes with practical authentication measures, including what practitioners can build into an execution to make a fabricated signing harder, and what to preserve in case one is later alleged.

The Latest in Gift & Estate Tax

Daniel Gespass

This session will explore the latest developments in trust modifications, decantings, and sophisticated estate planning strategies. The program will examine CCA 202352018 and the McDougall case, including their implications for modifying and decanting trusts, as well as the application of the new Section 68 limitation to trusts. Also addressed will be the IRS’s continued scrutiny of Grantor Retained Annuity Trusts (GRATs), including CCAs 201939002 and 202152018 and the Elcann case. Additional topics will include contingent general powers of appointment for GST planning, with a look at PLR 202531004 and PLR 202507005, and the evolving treatment of remainder interest GRAT sales. Attendees will gain practical insights into these developments and how they may affect trust administration, estate planning, and the design of advanced wealth-transfer strategies.

All About that Basis: Income Tax Basis Planning in Your Estate Plans

With the current historically high estate and gift tax exemption amounts, many clients are more focused on the income tax consequences of their assets (instead of the potential death taxes). This session will discuss the basis rules for inter vivos and testamentary transfers and how these rules impact the estate plans of clients. Additionally, the session will also discuss strategies to take advantage of the basis rules, including general powers of appointment and swapping low basis assets out of irrevocable trusts.

Developments in Addressing Heirs’ Property and Tangled Titles Matters: Law Reform and Other Interventions

Over the course of the past decade or so, there has been greater awareness among many stakeholders about a range of so-called heirs' property and tangled title matters. Unfortunately, heirs' property ownership and tangled titles are associated with a range of legal problems that not only negatively impact many families but also can have negative community-wide impacts. This session provides an overview of certain recent development of law reform measures and other interventions designed to mitigate some of the problems, including some that have become law or that otherwise have been implemented in various jurisdictions.

Non-Profits and the Charitable-Minded Client: When and How to Involve the Attorney General’s Office

Timothy Mazzocca, Jennifer Rawson

Advising nonprofits, fiduciaries and charitably minded clients often means knowing when the Attorney General’s Office needs to be involved and how to approach that process effectively. This session will address common circumstances that may trigger notice, consultation, or approval requirements, and will offer practical guidance for navigating communications with the Attorney General’s Office.

Charitable Giving in Today’s DEI Landscape

Beth Dougherty, Brian Gilboy

As donors increasingly seek to align their philanthropy with equity-focused values, this session explores the intersection of estate planning, charitable giving, and the evolving DEI legal landscape. Trusts and estates attorneys must structure gifting to optimize donor intent, while balancing compliance with relevant tax law and with the current state of enforcement and interpretation of anti-discrimination laws. Nonprofit counsel must then navigate how those gifts are received and used by the recipient nonprofit organizations. We will examine the legality of directing charitable gifts to specific classes of beneficiaries, including race-conscious or identity-based criteria, and analyze where legal boundaries are being tested.

Attendees will gain insight into how recent legal developments and heightened scrutiny are redefining what is permissible — or perceived to be impermissible — in restricted gifts, donor-advised funds, and testamentary bequests. The program will also highlight risks presented by overly restrictive or vulnerable gift or donation provisions, along with practical strategies to modify or preserve charitable intent when challenges arise.

Exercising, Challenging and Defending Trustee Discretion

Alison Smith, Rebecca Hagan

An in-depth evaluation of best practices for the exercise of trustee discretion, addressing what factors trustees can and/or should consider when exercising discretion and what information they require from beneficiaries. Discussion will include the standards for evaluating a trustee’s decision-making, when it’s appropriate to challenge a trustee’s exercise of discretion and how best to defend a trustee’s decision-making.

PA Inheritance Tax

Vicky Trimmer

The preparation of the Pennsylvania inheritance tax return, using a schedule-by-schedule approach, will be covered. This session will be especially helpful for preparers who have limited experience in preparing returns or who need a rapid review of the entire return.

When the Documents Are Technically Right but Practically Wrong: Early Diagnosis of Family and Governance Failures in Estate Planning

Ross Bruch, Benjamin Persofsky

Using a focused case study drawn from real-world family enterprise scenarios, the session examines a multigenerational business in which legacy control, unclear authority, and family identity issues quietly undermine governance, fiduciary judgment, and succession planning. Over time, these unresolved dynamics lead to professional management breakdowns, beneficiary resentment, trustee tension, and the types of disputes that eventually surface in trust administration and Orphans’ Court litigation. This CLE helps practitioners avoid becoming expert problem solvers for the wrong problem and strengthens their ability to deliver advice that works in real families, not just in documents.

From Parchment to Pixels: Electronic Estate Planning Documents in Pennsylvania

This presentation examines the growing movement toward electronic execution of wills and other estate planning documents, with a focus on Pennsylvania's current statutory framework and pending legislation in Pennsylvania.    It explores how multiple states have already enacted electronic will legislation and draws practical lessons from their varied approaches — including supervising-attorney requirements, qualified-custodian models, and remote-witnessing protocols.     The presentation also addresses the electronic execution of non-testamentary documents, as well as key issues around risks of utilizing electronic signatures on documents frequently used in an estate and trust practice.     Attendees will come away with a comprehensive understanding of the current legal landscape in Pennsylvania and practical guidance for utilizing electronic signatures.

The Road to Distribution: Accounts, Audits & Closing the Estate

Administering an estate does not end when the assets are collected and taxes are paid. The final stages of estate administration often present some of the most important opportunities to protect the personal representative, satisfy beneficiaries, and avoid future disputes. This program provides a practical roadmap through the accounting, audit, distribution, and estate-closing process in Pennsylvania.

Designed for newer practitioners and attorneys seeking a refresher, this session will explore informal and formal accountings, family settlement agreements, audits and adjudications, statements of proposed distribution, fiduciary and attorney compensation, and best practices for documenting and completing final distributions. Attendees will also learn how to navigate special distribution issues involving trusts, minors, and in-kind assets, while ensuring compliance with Pennsylvania procedural requirements and risk-management considerations.

By the end of the program, participants will understand the documents, procedures, and practical steps necessary to move an estate from final accounting to successful closure.

Intestacy Rules of Succession

When you die without a will, the default rules of inheritance law kick in, allocating assets based on established formulas and hierarchies. However, Pennsylvania intestate laws impact more than just an inheritance. This course explains basic inheritance law and delves into the default rules that come into play when a person dies without a will (“intestate”) and how these are often at odds with common expectations when it comes to an individual’s legacy. This course will also cover the impact of intestacy rules with fiduciary succession, bonding issues, and possible procedural hurdles in the probate process.

Eileen Gilbert Murphy, Esq.

Eileen Murphy is a partner with Momjian Anderer LLP, where she represents families in divorce, support, and custody matters. She practices in Philadelphia and the surrounding counties, both in Pennsylvania and New Jersey. A graduate of Temple University Beasley School of Law and Furman University, Eileen is well versed in both litigation and less adversarial cooperative resolutions. She is active with the Pennsylvania Bar Association Family Law Section in the membership committee, the Cipriani Inn of Court, and in the Philadelphia Bar Association Family Law Section, where she served as chair of the Section in 2021. Robert M. Lodge, Esq.

Robert M. Lodge is a Staff Attorney at Disability Rights Pennsylvania, where he represents individuals with disabilities in matters involving guardianship and supported decision-making. Robert earned his LL.M. in Trial Advocacy from Temple University’s Beasley School of Law and his J.D. from Widener University Delaware Law School. Before joining Disability Rights Pennsylvania, he served as an Assistant Public Defender, where he ultimately became Chief of Diversionary and Re-Entry Programs, overseeing initiatives including Mental Health Treatment Court and other specialty court programs. Throughout his career, Robert has been dedicated to representing individuals with mental health conditions and other disabilities, advocating for their rights and access to justice within the legal system.

Jennifer L. Rawson, Esq.

Ms. Rawson is a member in Eckert Seamans Cherin & Mellott, LLC’s Estate and Trusts practice group in Pittsburgh. She has advised individuals with respect to their estate planning since 1993 and has represented individual and corporate clients in all aspects of
estate and trust administration. Ms. Rawson counsels clients with respect to both simple and complex planning for a variety of needs that range from those of the single individual to complicated second marriages and succession planning for closely held business owners. In addition, Ms. Rawson has considerable experience in advising and representing a variety of nonprofit organizations including public charities, private foundations, business leagues and other social welfare organizations with respect organization and formation, obtaining and maintaining tax exempt status, ongoing state and federal compliance, all manner of

Alexandra M. Sipe, Esq.

Alexandra M. Sipe is the founder of Sipe Law LLC. Ms. Sipe focuses on estate planning for individuals, succession planning for family farms, advising individual and corporate fiduciaries on trust and estate administration legal issues. Ms. Sipe was the inaugural Trailblazer Award recipient for the Pennsylvania Bar Association’s Real Property, Probate and Trust Law Section and currently serves as Vice-Chair representing probate and trust on the Real Property Probate and Trust Law Section’s council. Ms. Sipe received his B.A., Double Major Economics and Political Science, from Dickinson College, and his J.D. from The Dickinson School of Law, Pennsylvania State University.

Courtney M. Wentzel, Esq.

Courtney is a litigator and Member (partner) at McNees Wallace & Nurick. Her practice focuses on fiduciary and guardianship litigation. She handles complex matters involving trusts, estates, powers of attorney, and guardianships. Courtney represents petitioners, professional guardianship agencies, and corporate fiduciaries in guardianship matters, as well as individuals and professional fiduciaries, including banks and trust companies, in sophisticated trust matters. She advises clients on the interpretation of trust documents, fiduciary risk management, and guardianship proceedings in Orphans’ Courts throughout Pennsylvania. While a strong advocate in the courtroom, she is equally focused on achieving practical resolutions that align with her clients’ goals. Beth Dougherty, Esq.

Beth Dougherty is the Director of Legal Education Initiatives at Cheshire Law Group in Philadelphia. Beth has advised a wide range of nonprofit organizations on all aspects of their activities, including formation and tax-exempt status, board governance, federal and state laws and regulatory compliance, mergers, affiliations, and fundraising compliance. She has also served on the boards of grassroots nonprofit organizations and worked directly in the nonprofit sector, supporting public education initiatives through the City of Philadelphia’s Community Schools Program and child health as a Project Coordinator at Children First. An active volunteer in her community, Beth has been involved with the East Passyunk Crossing Civic Association since 2008. Julie Rapaport

Julie Patter Rapaport is a partner at Pietragallo Gordon Alfano Bosick & Raspanti, LLP and a member of the firm’s Estate & Trust Litigation; Estate Planning and Administration Practice Group. Her practice includes all aspects of estate planning, as well as probate, trust, and estate administration. Prior to focusing her practice on trusts and estates, she practiced commercial litigation, representing international, national, and regional clients in a broad range of complex commercial disputes. Ms. Rapaport is actively involved in the legal and nonprofit communities and serves as President of the Board of Directors of Connected Nest, a nonprofit organization serving the greater Pittsburgh region. Bass Wilder Chadwick is the founder of Chadwick Estate Law PLLC in Radnor, Pennsylvania, where he focuses his practice on estate planning, trust and estate administration, fiduciary litigation, and Orphans’ Court matters. Before founding his firm, he practiced in the Taxation & Wealth Planning Department of an Am Law 100 firm and previously represented clients in trusts and estates matters at a Pennsylvania trusts and estates boutique. Andrew Monastra

Andrew Monastra was born and raised in Delaware County, Pennsylvania, graduating from Cardinal O’Hara High School in 1978, and graduating from Villanova University in 1982, with a degree in Operations Management. Andrew next earned his MBA in Systems Management from Drexel University in 1984. Prior to going to law school, he was an engineer with ICI Americas, a defense and aerospace pyrotechnic contractor. Here, Andrew was one of the designers of the first mass produced air bag igniters, with his design featured in the 1984-1985 Ford Tempo/ Mercury Topaz air bag igniter system. While working full time in the aerospace industry, Andrew earned his Juris Doctor degree in 1991 from Widener University, and was admitted to the Pennsylvania Bar in December, 1991. Since that time, he has been practicing law in Pottstown focusing exclusively on real estate law and his title insurance agency, Heartland Abstract, Inc. Andrew is a founding member and principal at Monastra & Grater, LLC, a boutique firm in Pottstown which focuses on Estate and Real Estate Law. In addition to his law practice, Andrew sits on Borough Council for the Borough of Pottstown, and lends his time to many other charitable and community boards in the Borough of Pottstown such as Edgewood Historic Cemetery, Steel River Playhouse, Pottstown Historical Architectural Review Board, Pottstown Planning Commission, Pottstown Land Bank, and the Pottstown Business Development Improvement District. Jessica Grater, Esq.

Leanne M. Schenck is an associate attorney at Heckscher, Teillon Terrill & Sager, P.C. in West Conshohocken, Pennsylvania. Robert Campbell, M.Ed.

A Pennsylvania native who’s always lived within the Susquehanna watershed, Robert Campbell has an honors theatre degree and M.Ed. from Penn State University. After a career spent in nonprofit arts, education, conservation, and communications (including adjunct teaching in Humanities and Theatre at Penn State Harrisburg), he is grateful to be working on behalf of older Pennsylvanians and persons with guardians in his work with the Office of Elder Justice in the Courts. Daniel Gespass, Esq.

Daniel Gespassis a managing director in the US National Tax practice at Andersen. He focuses on taxation issues related to trust and estate planning and has extensive experience advising on complex estate, gift, generation-skipping transfer, and fiduciary income tax issues. Dan brings over a decade of experience in both the public and private sectors. Before joining Andersen, he served as a senior technician reviewer at the IRS Office of Chief Counsel, where he played a key role in drafting and reviewing Treasury regulations, sub-regulatory guidance, and private letter rulings related to transfer taxation and fiduciary income tax. Thomas Mitchell

Thomas W. Mitchell holds the Robert F. Drinan, S.J. Endowed Chair at BC Law and serves as the Director of the Initiative on Land, Housing & Property Rights, which seeks to help disadvantaged people and communities acquire and secure important property rights. Prior to joining Boston College in 2022, he served as a tenured professor on the faculties of the University of Wisconsin Law School (2000-2016) and Texas A&M University School of Law (2016-2022). In 2017-2018, he served as interim Dean of Texas A&M School of Law. Professor Mitchell is a national expert on property issues facing disadvantaged families and communities, and has published leading scholarly works addressing these matters in academic journals, government publications, and publications for trade associations such as the American Bar Association. He has been interviewed by numerous media outlets including the New Yorker, The New York Times, The Washington Post, USA Today, NPR, ProPublica, The Nation, Politico, Mother Jones, the Atlanta Journal-Constitution, the Canadian Broadcasting Corporation, VICE, and many more. Professor Mitchell has engaged in extensive law reform and policy work, most prominently serving as the principal drafter of a widely adopted uniform real property act named the Uniform Partition of Heirs Property Act (UPHPA), which is designed to substantially enhance the ability of disadvantaged families to maintain ownership of their property and their property-related generational wealth. States with a majority of the U.S. population have enacted the UPHPA into law, making it one of the most successful uniform acts the Uniform Law Commission has promulgated in recent times. In addition to the 21 states, District of Columbia and the U.S. Virgin Islands that have enacted the UPHPA into law thus far, UPHPA bills have been introduced in several other state legislatures in 2022, and it is expected that a number of other state legislatures will consider the UPHPA in the years to come. In 2021, the Uniform Law Commission accepted a new proposal Professor Mitchell developed to address a different tenancy-in-common ownership problem, which likely will result in another uniform act that states will be able to consider. He also has helped to develop federal policy proposals, working with among others some in Congress, to assist disadvantaged farmers and property owners. In 2020, Professor Mitchell was named one of 21 recipients of the MacArthur Fellowship in recognition of the substantial impact his professional work has had in assisting disadvantaged farmers and property owners, people who are disproportionately but not exclusively African American and other people of color. He is the only lawyer in his MacArthur Fellowship class. In 2021, he was awarded the Howard University Award for Distinguished Postgraduate Achievement, an award that Thurgood Marshall and Vice-President Kamala Harris, among other Howard luminaries, also have received. Also in 2021, The Journal of Black Innovation named Professor Mitchell as one of the 50 most important African Americans in infrastructure, recognizing that his work protecting property rights for people of color helps create a more just and equitable infrastructure system. In 2022, Professor Mitchell received the American Bar Association’s Jefferson B. Fordham Advocacy Award, one of the most prestigious awards for lawyers in the United States, which recognizes “outstanding legal advocacy within the area of state, local, regional and tribal government law.” He is a previous recipient of the Elizabeth Hurlock Beckman Award, a national award he received for the substantial work he has done mentoring law students who have then worked as lawyers to advance social justice. Professor Mitchell is a graduate of Amherst College, the Howard University School of Law, and the University of Wisconsin Law School where he received an LL.M. (masters of law) and served as a William H. Hastie Fellow.

Timothy Mazzocca, Esq.

Timothy Mazzocca has served as a Senior Deputy Attorney General in the Pennsylvania Office of Attorney General’s Charitable Trusts & Organizations Section since 2020 and was named Attorney-in-Charge of the Charitable Trusts & Organizations Section of the Western Regional Office in June 2026. He previously served since 2013 in the Attorney General’s Civil Litigation Section. He received a BA summa cum laude from the University of Notre Dame in 2004, a MA from The Ohio State University in 2005, and a JD summa cum laude from the Duquesne University School of Law in 2009. In his daily job duties, he regularly deals with matters affecting nonprofits, including dissolutions, mergers, and investigations into alleged malfeasance.

Benjamin Persofsky

Benjamin Persofsky is the Head of the BBH Center for Family Business, which counsels some of the largest business-owning families in the world on the unique issues that occur at the intersection of owners’ businesses, their families, and their wealth. These topics include owner strategy, succession, governance, next generation owner development, and conflict. He is a frequent speaker at conferences on those topics, as well as on innovative approaches to share redemption, capital allocation, and dividend policies. Prior to joining the firm, he was employed by M&T Bank.
Philanthropically, Ben is a board member of the Philadelphia Orchestra & Ensemble Arts. He is also a volunteer pilot with Angel Flight East. Lois Murphy has been a Judge of the Court of Common Pleas in Montgomery County, since 2010, and the Administrative Judge of the Orphans’ Court Division since 2015. He graduated from The Pennsylvania State University, where he received his bachelor’s degree in history in 1990. In 2001, Mr. Gusdorff graduated magna cum laude from the Temple University James E. Beasley School of Law, where he served as a note and comment editor of the Political and Civil Rights Law Review. He was an adjunct professor for 11 years in Temple’s graduate tax program, where he taught a class with Pennsylvania Superior Court Judge Anne E. Lazarus on Orphans’ Court pleading and trial practice. Before attending law school, Mr. Gusdorff worked for eight years as a sports writer in suburban Philadelphia and won a Keystone Press Award for outstanding sports writing in 1998.

Vicky Ann Trimmer, Esq.

Ms. Trimmer is a partner in the Harrisburg area law firm of Daley, Zucker, LLC, where she concentrates in estate planning and administration, business organization and planning, Pennsylvania state and local taxation and agricultural law. She received her B.S. from the University of Pittsburgh and was awarded her J.D. from the Dickinson School of Law. She also received an associate’s degree in Business Administration from Harrisburg Area Community College. Ms. Trimmer served as Senior Assistant Counsel with the Pennsylvania Department of Revenue of the Office of Chief Counsel. She is also a Certified Public Accountant. She was elected as a Fellow of the American College of Trust and Estate Counsel in October 2019. Ms. Trimmer has made numerous presentations before professional organizations, including the PICPA conferences and Pennsylvania Bar Institute events. She is a member of the Pennsylvania, Dauphin County and Cumberland County Bar Associations and the Pennsylvania Institute of Certified Public Accountants. Ms. Trimmer is a past adjunct associate professor of law at the Dickinson School of Law of the Pennsylvania State University. She is a past president of the Estate Planning Council of Central Pennsylvania, Inc. Ms. Trimmer is a member of the Upper Allen Women’s Club and the General Federation of Women’s Clubs Pennsylvania, which is a women’s organization dedicated to community improvement by enhancing the lives of others through volunteer service. Ms. Trimmer served as state president of GFWC PA for the 2013-2016 term. She is currently serving as a member of the GFWC international Board of Directors as Chairman of the Civic Engagement committee.

Dennis C. Reardon, Esq.

Mr. Reardon is the founder of Reardon & Associates, LLC, a law firm in Wayne. He specializes in tax matters related to estate, business and compensation planning. The firm’s clients generally are family owned businesses, professionals, executives, and fiduciaries or beneficiaries of trusts and estates. Terrance A. Kline, Esq.

Mr. Kline’s practice is devoted to estate planning and estate and trust administration. Obadiah English, Esq.

Mr. English is a Partner at MannionPrior, LLP. His practice is concentrated in litigation involving trusts, estates, guardianships and other fiduciary matters. He has represented both individuals and corporate clients in a variety of matters in the Orphans’ Court and the Civil Division of the Court of Common Pleas of Pennsylvania, including will and trust contest, trust litigation, probate disputes and fiduciary surcharge actions. Mr. English has also appeared on appellate matters before the Superior, the Commonwealth and the Supreme Courts of Pennsylvania. Jennifer Nevins, Esq.

Ms. Nevins is a shareholder in Stevens & Lee’s Trusts and Estates practice group and concentrates ber practice in Orphans’ Court matters, including the administration and settlement of trusts and estates, trust reformations, guardianship proceedings and administration, and litigation involving fiduciary matters and the interpretation of estate planning documents. She advises clients on matters of regulatory compliance by corporate fiduciaries. Richard Holzworth, Esq.

Hon. Shawn Meyers

Since January, 2010 the Honorable Shawn D. Meyers has served as a judge for the Court of Common Pleas for the 39·”Judicial District which is the general trial court for Franklin & Fulton Counties, Pennsylvania. In December, 2019, he began serving as President Judge. He lives in Chambersburg with his wife, Nancy, a practicing attorney. Judge Meyers has served as chair of the following committees during his time on the bench: 39th Judicial District Orphan’s Court Local Rules Committee, 39·• Judicial District Civil Procedure Local Rules Committee, 39″ Judicial District Family Law Committee and has been a member of the Franklin County eFiling and Civil Case Management Committee and Criminal Justice Advisory Board. Jay R. Hagerman, Esq.

Jay R. Michael Rogers, Esq.
