The discussion will highlight selected topics on wealth planning for individuals in partnerships holding appreciated assets, including goodwill. Observations as to which transfer planning strategies hold greater promise than others, looking at the valuation process in general in valuing interests in unincorporated entities, working with expert valuation appraisers both during the reporting and tax controversy and litigation process, work product and privilege issues in the event an audit occurs, impact of the centralized partnership audit rules.

Mr. August is a partner in the Philadelphia office of Fox Rothschild LLP, who also practices out of the Firm’s New York (and West Palm Beach) offices. He is Co-Chair of the Firm’s International Taxation & Wealth Planning Group. He previously served as Co-Chair of the Tax & Estates Department and Chair of the Tax Opinions Committee. Mr. August is a national authority on federal international and domestic taxation and is a frequent lecturer throughout the U.S. on federal tax matters, including corporate and partnership taxation, international taxation, wealth transfer taxation and tax controversy and tax litigation. He is Editor-in-Chief of Corporate Taxation (WG&L) and writes a regular column on cross-border taxation. He is Editor-in-Chief of The Practical Tax Lawyer (ALI) and past Editor-in-Chief of The ABA Tax Section’s publication, Tax Lawyer, Vols. 58 & 59, which is the leading law review for tax practitioners in the U.S. He is a long-standing member of the Advisory Board of the New York University Institute on Federal Taxation (1990-present) and has served as Chair of the Institute on Federal Wealth Taxation (2006 to 2010) and Chair of the NYU Annual Institute on Federal Taxation Closely-Held Businesses Session (2001-2022). He has chaired and participated in various national programs including the Graduate Tax Program of the NYU School of Law, ALI-ABA, ABA Tax Section, and various state bar programs and institutes, including the Pennsylvania Bar Institute. He is a member of the American College of Tax Counsel, the American College of Trust and Estate Counsel, American Tax Policy Institute, American Law Institute, and member of the Consultative Groups on Restatement (Third) of Donative Transfers and Restatement (Third) of the Law of Trusts. Mr. August represented the Tax Section of the Florida Bar Association before the United States Supreme Court in Estate of Hubert v. Commissioner, 520 US 93 (1997). He also has served as adjunct professor for the University of Miami Law School, visiting professor at the Graduate Tax Program at the University of Florida School of Law, University of Pittsburgh School of Law, and as guest lecturer at the University of Pennsylvania School of Law. He recently taught business law at Franklin & Marshall College.
