Importance of a (Realistic) Work-Life Balance

The noted jurist, Benjamin Cardozo, once wrote that “happiness may not exist in a successful lawyer’s life.” Is it the stress that begins in law school when we realize that the qualities that made us succeed as students may not be the same qualities that will make us successful lawyers? Or, perhaps, that the qualities that make for a successful legal career may differ from the qualities that make for a happy human being?

Regardless of what stage you may be in your career, the undeniable truth is that a stress free life is difficult to attain. Recent studies have shown that there has been a dramatic increase in impairment due to alcoholism, addiction and mental health disorders among members of the legal profession and that 1 out of 3 attorneys will likely have a need for substance use or mental health services at some point in their careers.

Join our experienced panel as they discuss:

· Causes, symptoms and common warning signs of alcohol and substance use disorders, as well as mental health issues such as depression, stress and anxiety.

· How untreated work-related stress can often turn into burnout.

· Well- being strategies to reduce or alleviate these conditions and maintain healthy work/life balance

· Transformation: Starting and ending a legal career.

· Community: How to create one within and outside the context of the law.

· Why legal professionals are at higher risk to develop mental health and substance use disorders.

· Challenges and barriers facing legal professionals from seeking help.

· The free, confidential services provided by Lawyers Assistance Programs to lawyers, judges, their family members and law students.

Dealing with Attorney Impairment and Incapacity

Lawyers have an ethical duty to ensure the continuity of client representation, even if they become temporarily disabled. As a result, attorneys must take reasonable steps to protect their clients' interests, which includes having a succession plan in place. This session will:

• Discuss ways to plan for and deal with attorneys who suddenly become incapacitated;

• Outline the need for firms and solo practitioners to establish procedures that protect client funds, files, and confidential information during an attorney’s incapacity.

Hot Topics in Ethics

This section will highlight recently issued Formal and Joint Ethics Opinions, including updates to fee agreement requirements under Rule 1.5, and evolving obligations related to confidentiality, cybersecurity, and attorney competence in technology-driven practices.

Faculty

Paul Cockeram

Paul Cockeram is a professor of rhetoric, literature, and creative writing with an extensive background in existentialist philosophy. He has a Bachelor’s degree in English and Theatre Arts, a Master’s in English from Iowa State University, and a Masters of Fine Arts in Creative Writing from the University of Idaho. He lives and works in Harrisburg, Pennsylvania with his wife, the writer Jennifer Hirt.

William L. Adler, Esq.

William L. Adler, Esquire began practicing law with his father and grandfather in 1983, primarily in the fields of estate administration, estate planning and real estate. He has served on a number of director boards, including that of the Jewish Home of Greater Harrisburg, Neighborhood Dispute Settlement (a volunteer mediation organization) and the Dauphin County Bar Association as chair of the solo committee and the Estate Planning and Probate Section. He started lecturing on retirement planning for attorneys beginning around 2013 for the Dauphin County Bar Association and the Pennsylvania Bar Institute.
He and Paul Cockeram have written a book entitled “Mindful Retirement.” They conduct workshops teaching the contents of the book which focuses on rediscovering meaning and purpose in the context of retirement.

Brian S. Quinn, Esq.

Mr. Quinn is a licensed attorney in Pennsylvania who currently serves as the Education and Outreach Coordinator for Lawyers Concerned for Lawyers of Pennsylvania, Inc., a Lawyers Assistance Program established in 1988 for the purpose of helping lawyers, judges and law students recover from alcoholism, drug addiction and mental health disorders. Mr. Quinn obtained his undergraduate degree in 1970, his law degree in 1973 and a certificate in Drug and Alcohol counselling in 2012, from Villanova University. Prior to his work with Lawyers Concerned for Lawyers, he was a private practitioner for over 40 years and has also worked in the field of Alcohol and Drug Counseling in suburban Philadelphia. Mr. Quinn is a past member of the Board of Directors of Lawyers Concerned for Lawyers of Pennsylvania and served as a peer volunteer for over six years prior to accepting his current role as the organization’s Educator in 2017. He has written and presented on lawyer wellness topics to law firms, Bar Associations and legal education providers for state, national and international groups as well.

Ellen Freedman, CLM

Ellen serves as the Law Practice Management Coordinator for the Pennsylvania Bar Association. In that capacity she assists PBA’s members with management issues and decisions on the business side of their practice, including areas like technology, financial management and profitability, human resources, marketing, risk management, setting up a practice and so forth. Ellen is founder and President of Freedman Consulting, which assists PA law firms with a full range of issues and projects on the business side of the practice. Ellen holds the designation of Certified Legal Manager through the Association of Legal Administrators (ALA), the credentialing body for the CLM degree. Of the 11,000+ members of the ALA, approximately 300 are certified legal managers. Ellen was one of the first 20 in the nation to have achieved this designation. She holds a Certification in Computer Programming from Maxwell Institute, and a Certification in Web Site Design and a B.A. from Temple University. Ellen was inducted as a Fellow of the College of Law Practice Management in October 2020. Membership in the College is by invitation only. Eligible nominees include those who have made significant contributions to the field of law practice management for over ten years. Since its establishment over twenty years ago, nearly 300 practitioners from 5 different countries have become Fellows of the College. Ellen managed inside law firms for twenty years. Most of that time was spent in a midsize (35+ attorney) firm environment. She launched her consulting practice in 1998 and joined the Pennsylvania Bar Association in 1999. She was a member of the Association of Legal Administrators for over 20 years and founded the Independence Chapter. She is a frequent author and speaker on law firm management issues on a national level.

Daniel J. Siegel, Esq.

Attorney Daniel J. Siegel is a nationally recognized authority on ethics, technology, data protection and business workflow management, and the principal of both the Law Offices of Daniel J. Siegel, LLC and Integrated Technology Services, LLC. Dan provides techno-ethics counsel to solo, small and mid-sized law firms on cybersecurity, technology and other related issues. His practice includes representing of attorneys in disciplinary matters; providing professional responsibility guidance to attorneys and firms; serving as appellate counsel; and representing individuals in workers’ compensation and personal injury matters. Dan also consults with law firms and businesses on workflow management, implementation of paperless offices, and other productivity matters. Attorney Siegel is a prolific speaker and author, and serves as the Chair of the Pennsylvania Bar Association Committee on Legal Ethics and Professional Responsibility, and Past-Chair of the American Bar Association’s Professional Development Board Chair. The author of 15 books, Dan is a columnist and frequent lecturer on a wide range of topics, including ethics, technology, substantive law, appellate law, and professional responsibility matters.
