Faculty

Michael J. Lyon, Esq.

Mr. Lyon is an attorney at the firm of Walsh Pancio LLC in Lansdale, PA. Prior to his current position, he was an associate attorney at Kane Pugh Knoell Troy & Kramer and at Duane Morris LLP. He graduated from Villanova University School of Law in 2009. In addition to being a member of PBA’s 2017-2018 Bar Leadership Institute class, he serves as the Chair of the Gaming Law Committee, and a member of the Civil Litigation Section, Law Related Education Committee, and Quality of Life Committees. 

Stephen S. Cook, Esq.

In December 2021, Mr. Cook was named as Chief Counsel to the Pennsylvania Gaming Control Board, an independent agency of the Commonwealth which regulates casino gaming, sports wagering, online wagering (including on-line sports wagering), and video gaming terminal wagering throughout Pennsylvania.  The Office of Chief Counsel is charged with providing legal advice and representation to the agency and its 7 member Board, including advising the Board on matters coming before it for consideration and representing the Board in external litigation matters. The Office of Chief Counsel also advises the Board and executive staff on administrative matters in the areas of procurement, contracting and human resources. Between 2008 and 2021, Mr. Cook was Deputy Chief Counsel for Administration and Litigation with the Board.  Prior to joining the Board in 2006 as an Assistant Chief Counsel advising the Board’s Bureau of Licensing, Mr. Cook was in private practice for 7 years with Cerullo, Datte and Walbillich, Pottsville, PA, a firm focusing on business and transactional law, real estate and commercial litigation. Mr. Cook was also previously employed as a Deputy Attorney General with the Pennsylvania Office of Attorney General, serving both as a criminal prosecutor and legislative liaison, and was also employed as Counsel to the Majority Whip of the Pennsylvania State Senate. Before beginning his legal career, Mr. Cook worked as both a juvenile and adult probation officer.  He received his B.A. from the Pennsylvania State University; his M.S. from Shippensburg University; and his J.D. from the University of Baltimore School of Law.

Kevin C. Hayes, Esq.

Kevin C. Hayes is a partner in the gaming practice group of Saiber LLC. Kevin has nearly 20 years’ experience in the gaming industry. Kevin represents casinos, racetracks, gaming manufacturers, online gaming operators, sportsbook operators and video terminal operators in a variety of corporate, regulatory and compliance matters. Prior to entering private practice, Kevin served as the first Director of Gaming Operations for the Pennsylvania Gaming Control Board (PGCB), where he established and supervised the Bureau of Gaming Operations. As the director, Kevin acted as the agency’s chief compliance officer and was responsible for reviewing and approving the gaming floor plans, internal controls and audit protocols of all licensed casinos in Pennsylvania. Kevin joined the PGCB in 2005 as an Assistant Chief Counsel, assigned to the Bureaus of Licensing and the Office of Racetrack Gaming. In 2007, Kevin was appointed as head of the PGCB’s Opening Team and supervised the successful openings of Pennsylvania’s first casino facilities. Kevin is a graduate of Villanova University School of Law and Fairfield University. He is admitted to practice before the Supreme Court of Pennsylvania and the Supreme Court of New Jersey, as well as the U.S. District Court for the Middle District of Pennsylvania and the U.S. District Court for the Eastern District of Pennsylvania. Kevin is a member of the International Association of Gaming Advisors and the International Masters of Gaming Law. He currently serves as Chair of the Pennsylvania Bar Association’s Gaming Law Committee and was a course planner and panelist for the Pennsylvania Bar Institute’s 2007 and 2021 Gaming Law Updates.

Scott M. Leopold, Esq.

Scott Leopold is an Associate wtih Duane Morris LLP. His practice focuses on the gaming industry. Mr. Leopold has facilitated gaming licensure of individual qualifiers, casinos, sports data service providers, internet gaming companies, sports betting companies, media companies and marketing affiliates from initial application preparation through extensive regulatory investigative requests and final licensure approval. He also has experience analyzing state and international legislation, rules, and regulations to assess gaming licensure requirements, the legality of sports wagering systems, gambling prohibitions concerning employees, qualifiers and owners of sports betting operators and related regulatory matters. Mr. Leopold is a 2020 cum laude graduate of Drexel University Thomas R. Kline School of Law and a graduate of the University of Wisconsin.

Kristine E. Marsilio, Esq.

Kristine E. Marsilio is a senior associate with Duane Morris LLP where she practices in the area of gaming law. Ms. Marsilio has assisted clients in obtaining the necessary approvals and licenses to establish Category 4 casinos and to conduct gaming operations, including i-Gaming, sports wagering, and pari-mutuel wagering. She also provides legal opinions and regulatory guidance pertaining to the legality of gaming operations and compliance with state and federal requirements. Ms. Marsilio has experience with analyzing and interpreting gaming laws and regulations and represents the interests of clients in matters before the Pennsylvania Gaming Control Board and the Pennsylvania judiciary. Ms. Marsilio is a cum laude graduate of Duquesne University School of Law, where she was senior staff editor of the Law Review, and a magna cum laude graduate of Ithaca College.

Jennifer Aguiar, CRCM, CAMS, CIPP/US

Jennifer Aguiar is the Chief Compliance Officer for DraftKings Inc. She previously served as the company’s Vice President, Compliance and Risk. As Chief Compliance Officer, she is responsible for overseeing corporate compliance and enterprise risk management. Among other responsibilities, she ensures DraftKings’ compliance with all U.S. and international licensing requirements related to daily fantasy sports, sports betting and iGaming. Aguiar joined DraftKings in 2016 as Head of Compliance and Risk and led the development of the internal DraftKings compliance program from the ground up. She implemented a rigorous education and certification program for the compliance team, customer-facing employees and the company at large which instilled a uniform risk management and regulatory focus across all aspects of the business. Prior to joining DraftKings, Aguiar occupied compliance and risk management leadership roles at several large financial institutions, including serving as Director of Compliance at the Lending Club, and at Citizens Bank and Capital One in various risk management and compliance roles. Aguiar is a Certified Anti-Money Laundering Specialist (CAMS), Certified Information Privacy Professional/US (CIPP/US), Certified Risk Professional (CRP) and Certified Regulatory Compliance Manager (CRCM). She graduated from Bridgewater State University where she received a BS in Management Science with a concentration in Marketing and a Math Minor. She currently serves on the executive and advisory boards of the Ricciardi College of Business at Bridgewater State University.

Dustin L. Miller, Esq.

Dustin Miller is a Deputy Chief Enforcement Counsel for the Pennsylvania Gaming Control Board. He has worked for the PGCB for over 17 years in the Office of Enforcement Counsel. Prior to working for the PGCB, he worked in private practice for VanOrmer & Associates in Elizabethtown, PA for over 4 years as an associate attorney. He is a graduate of the Widener School of Law-Commonwealth Campus and conducted his undergraduate studies at Juniata College. He is licensed to practice in Pennsylvania.

John W. Crohe, III, Esq.

John Crohe is a Senior Enforcement Counsel Supervisor at the PA Gaming Control Board. He has worked for the PGCB for over 10 years. He is a graduate of Widener University School of Law, J.D., and of Temple University, B.A. He is licensed to practice in Pennsylvania and New Jersey.

David Foppert

David Foppert is Vice President of Global Compliance and Risk at DraftKings Inc., having served as Senior Director of Global Compliance and Risk prior to his current position. He is a graduate of Villanova University, MBA, and Rutgers University, BA, Political Science and Criminal Justice. He is a Certified Anti-Money Laundering Specialist.

David Tepper, Esq.

David Tepper is a Senior Enforcement Counsel Supervisor at the PA Gaming Control Board. He has worked for the PGCB for over 12 years, holding a variety of positions. He is a graduate of Temple University James E. Beasley School of Law, J.D., and Muhlenberg College, B.A. He is licensed to practice in Pennsylvania and New Jersey.

Cyrus R. Pitre, Esq.

On September 6, 2007, Cyrus Pitre was appointed the Director of the Pennsylvania Gaming Control Board’s Office of Enforcement Counsel pursuant to Section 1517 of the Pennsylvania Race Horse Development and Gaming Act. As Chief Enforcement Counsel, Cyrus is responsible for ensuring the regulatory compliance, enforcement, and prosecution of all matters under the Board’s jurisdiction. As head of the statutorily created independent Office, Cyrus’ duties include but, are not limited to: filing recommendations and objections on all licensing matters; providing advice and direction on background investigations, audits, inspections, and investigations of potential violations; initiating, in his sole discretion, proceedings for noncriminal violations; and petitioning the Board for certain relief as needed. Over the course of his 25-plus year career as a gaming regulator through appointments in Pennsylvania, New Jersey, and Louisiana, Cyrus has been directly responsible for the prosecution of over 100,000 regulatory matters in the gaming industry, many of which established precedence. Prior to his appointment in Pennsylvania, Cyrus was appointed and served as a Deputy Attorney General with the New Jersey Division of Gaming Enforcement and an Assistant Attorney General with the Louisiana Division of Gaming. He is licensed to practice law in Pennsylvania, New Jersey, and Louisiana. Cyrus earned his Juris Doctorate Degree from Southern University in Baton Rouge, Louisiana and his Bachelor’s Degree from the University of Louisiana in Lafayette, Louisiana.
