Overview

Hybrid legal custody is an increasingly common—but often misunderstood—custodial arrangement that blends elements of sole and joint decision-making authority. While designed to address high-conflict dynamics or uneven parental capacity, hybrid legal custody presents unique legal, practical, and enforcement challenges for courts and practitioners alike.

This program explores the history of hybrid legal custody, when and how hybrid legal custody is used, the statutory and case law frameworks that support it, and the real-world implications for families. Using actual cases, faculty will examine how decision-making authority is allocated, how disputes are resolved under hybrid models, and the risks of ambiguity in custody orders. The course will also address drafting considerations, modification standards, and best practices for advising clients before, during, and after litigation.

Attendees will leave with a clearer understanding of when hybrid legal custody may serve a child’s best interests—and how to navigate its complexities with precision and confidence.

Faculty

Judy Springer, Esq.

Judy is a partner at Astor Weiss Kaplan & Mandel LLP, where she practices family law exclusively (divorce, custody, child support, international child abduction (Hague) cases, and prenuptial agreements). Judy is an active member of the Pennsylvania and Philadelphia Bar Associations and their Family Law Sections. She has served on council for the Pennsylvania Bar Association and has served as the co-editor of the Pennsylvania Family Lawyer since 2019. Judy serves as the Chair of the Philadelphia Bar Association Family Law Section. Judy is an active member of the Cipriani Inn of Court. Judy has been named to the Super Lawyers list for family law since 2019 and to the “Best Lawyers in America” list by Best Lawyers for family law since 2018. In 2018, Judy received the Distinguished Advocate for Children Award in 2018 and was recognized in 2020 by the Pennsylvania Bar Association for her dedication as a co-editor of The Family Lawyer. In 2016, Judy received the Pro Bono Publico Award for the Court of Common Pleas – Trial Division – Dependency. Judy performs pro bono legal services as a child advocate through the Support Center for Child Advocates. Judy graduated from Virginia Tech with a B.A. magna cum laude and is a member of Phi Beta Kappa honor society. She graduated from The Villanova University School of Law in 1998.

Mark A. Momjian, Esq.

A graduate of Columbia College and the Columbia University School of Law, Mr. Momjian is co-founder of Momjian Anderer, LLC, a family law practice based in Philadelphia. Listed in The Best Lawyers of America and Who’s Who in America, he is co-author (with his late father, Albert Momjian) of Pennsylvania Family Law Annotated, published by Thomson Reuters and currently in its fourteenth edition. Mr. Momjian writes and lectures frequently about trends in domestic relations, with a special emphasis on biotechnology’s impact on family law. His LGBTQ advocacy is co-extensive with his legal career. In the mid-1980s, Mr. Momjian served as a member of the Women’s Law Project’s Working Group on the Legal Rights of Lesbian Mothers, where he was an early advocate of second-parent adoption. His articles on marriage and transgender equality date from this period. Mr. Momjian served as the first co-chair of the Committee on the Legal Rights of Unmarried Cohabitants of the Philadelphia Bar Association’s Family Law Section. As a member of the Alternative Families Committee of the American Bar Association’s Family Law Section, he has presented across the country on topics ranging from the interstate recognition of same-sex marriage to the elimination of sexual orientation as a factor in child custody adjudication. Mr. Momjian is the recipient of many awards and honors for public service, including Pro Bono Attorney of the Year presented by the Center for Lesbian and Gay Civil Rights, the Cheryl Ingram Advocate for Justice Award presented by the Philadelphia Bar Association, the Outstanding Advocate Award presented by SeniorLAW Center, and the Earl J. Harrison Award for Distinguished Pro Bono Service. In 2002, he handled the first appellate case in the nation involving a former domestic partner’s legal obligation to pay child support, and in 2006, he successfully defended the constitutionality of the Grandparent Visitation Act before the Pennsylvania Supreme Court. Mr. Momjian is an adjunct professor of law at the Villanova University School of Law, where he has twice been awarded Adjunct Professor of the Year by the Student Bar Association. Mr. Momjian is also an adjunct professor of psychiatry at Drexel University’s College of Medicine, where he lectures on mental health law. A member of the Domestic Relations Advisory Committee of the Joint State Government Commission, Mr. Momjian is an active member of the Pennsylvania Bar Association and is a member of the local bars of Philadelphia, Delaware, and Montgomery Counties.
