Overview

The VA issued Final Regulations which became effective on 10/18/2018 that substantially impact the treatment of net worth, asset transfers, and income exclusions and created a three year look back period for transfer of assets for less than fair market value.  The implementation of these regulations have affected the ability to qualify for VA Aid and Attendance Benefits and can also, potentially, impact a person’s ability to qualify for Medicaid benefits.  This session will provide an overview of the 2018 VA regulations, their impact on VA Aid and Attendance Benefits eligibility and Medicaid eligibility.

Robert Schweitzer Esq., CELA

Mr. Schweitzer is a certified elder law attorney (CELA) and an Associate Attorney with Julian Gray Associates in Pittsburgh. He received his Bachelor of Arts, magna cum laude, from Westminster College in New Wilmington, Pennsylvania. He received his Juris Doctor from the University of Pittsburgh School of Law. He focuses his practice on counseling individuals and families with respect to estate and long-term care planning as well as trust and estate administration. He currently serves on the board for the PBI Elder law Section and the Pennsylvania Association of Elder Law Attorneys. Prior to joining Julian Gray Associates, Mr. Schweitzer practiced for a mid-sized law firm in Pittsburgh in the Estates and Trust Services Group. Mr. Schweitzer has experience in litigating commercial, construction, securities and professional liability matters. He is recognized as a Pennsylvania Super Lawyer and in Best Lawyers in America.
