Timothy A. Carroll, Esq.
Tim Carroll is Of Counsel at Troutman Pepper Locke where he advises insurance companies on a wide range of first- and third-party claims, principally those arising under cyber, tech E&O, and media policies, but also those arising under professional liability, directors and officers, commercial property/general liability, and specialty lines insurance policies (both primary and excess). Tim also represents companies in high-stakes insurance coverage disputes in state and federal courts across the U.S., as well as in alternative dispute forums. Clients seek Tim’s guidance on their most challenging matters, often involving unusual or unsettled questions of law and claims seeking damages for bad faith and other extra-contractual relief. In the rapidly evolving cyber-exposure space, Tim counsels and represents insurers in their handling of first- and third-party claims arising from all manner of privacy and data security breaches, cyber extortion/ransomware, business email compromise, website tracking technology/pixels, and other cyber- and privacy- related exposures, including those amplified by the proliferation of artificial intelligence. Tim routinely advises cyber insurers on first-party claims seeking coverage for financial losses and system restoration costs and expenses, including those resulting from business interruptions. Tim also regularly counsels insurers on their handling of third-party cyber- and privacy-related claims, including those involving class action lawsuits, with an eye toward proactively and pragmatically resolving such claims. In all areas of his insurance coverage practice, Tim brings to bear his significant experience analyzing and pursuing risk transfer opportunities where other insurance, third-party contractual indemnification, and subrogation opportunities are available to offset or even eliminate his clients’ financial exposure.
Tim frequently comments on issues affecting the insurance industry. In 2020, Tim was named a Top 10 Contributor for insurance law as part of JD Supra’s Readers Choice Awards.
Esther Y. Kim, Esq.
Esther is a senior associate in Reed Smith’s Insurance Recovery Group, focusing her practice on representing corporate, commercial, and residential policyholders in disputes with insurance companies. She works primarily with Commercial General Liability (CGL), Directors and Officers liability (D&O), Professional Errors and Omissions (E&O), and first-party property policies, providing coverage opinions, counseling, and dispute resolution. Esther serves well-known clients in the banking and financial institutions, healthcare, hospitality, manufacturing, retail, transportation and energy sectors, as well as religious institutions and small and medium sized businesses. In law school, Esther was a judicial intern to the Honorable Pamela K. Chen of the United States District Court of the Eastern District of New York. Esther serves as co-chair of the Insurance Subcommittee of the Business Law Section of the Philadelphia Bar Association.
Konrad R. Krebs, Esq.
Konrad Krebs is based in Philadelphia and is a commercial trial and appellate lawyer representing insurance carriers and businesses in complex commercial, insurance, and bad faith litigation at Clyde & Co. Konrad focuses his practice on disputes involves large exposures and emerging issues of law that are likely to impact future industry disputes. As part of this practice, Konrad frequently represents insurance clients in emerging mass tort, environmental, and bankruptcy exposures. Konrad advises insurers in coverage disputes under all types of policies, including commercial general liability, directors’ & officers’, errors and omissions, employers’ liability, professional liability, excess, cyber, and first-party policies. Konrad has been at the forefront of some of the most contentious insurance disputes of the past decade, guiding clients through a litany of major mass tort bankruptcies, multidistrict litigation, and coverage disputes receiving industry-wide attention. Apart from his work for insurers, Konrad has also represented corporate clients and corporate officers in litigation arising out of myriad commercial disputes and has secured successful outcomes for clients in state and federal courts throughout the country. Konrad has further represented clients with interested stakes in impact litigation, drafting and submitting amicus curiae briefs, including in the United States Supreme Court.
Timothy Law, Esq.
Mr. Law is a partner at Reed Smith, where he represents policyholders in disputes with their insurance companies, specializing in property and liability insurance coverage and bad faith litigation. His clients include businesses of all sizes as well as non-profits and universities. Substantively, Mr. Law has broad experience in various areas of insurance law. As a member of the American Law Institute, he consulted in the drafting of the Restatement of the Law of Liability Insurance. He has obtained insurance recovery in TCPA and FCRA class actions and represents clients seeking insurance recovery for privacy and statutory liabilities under both general liability and professional liability insurance policies. Mr. Law regularly represents corporations in insurance company insolvency proceedings, helping his clients to enforce their rights against the insolvent insurance company, insurance guaranty associations, and reinsurance companies. In addition, he handles workers’ compensation insurance coverage, collateral, and premium disputes. Mr. Law also has extensive experience with directors and officers liability insurance mediation and litigation. Internationally, he has assisted clients in Bermuda and London arbitrations.
Thomas Seery, Esq.
Thomas J. Seery is a partner in the Philadelphia office of Kennedys Law LLP. He focuses his practice on representing and advising clients in complex insurance coverage matters and commercial litigation, including general liability, E&O and professional liability, pollution liability, bad faith, commercial property insurance, and construction defect, toxic tort, catastrophic loss, and policy rescission claims. Tom represents insurance companies in disputes in both state and federal courts, and has experience leading arbitrations, conducting depositions, and drafting and arguing motions at all stages of litigation. Prior to joining Kennedys, Tom represented insurers in insurance coverage matters at another Philadelphia firm. He also has experience in medical malpractice and employment litigation. Tom has been recognized as a Pennsylvania Super Lawyers Rising Star in 2018 and 2019 in the Global Insurance Services practice area. Tom sits on the Board of Directors for the Cornell Club of Greater Philadelphia, where he has served as Secretary since 2017. Tom has also served on the Board of the Cornell Big Red Band Alumni Association since 2015 and was elected Vice Chair in 2018.
Elizabeth L. Taylor, Esq.
Elizabeth Taylor is an associate in Reed Smiths Pittsburgh office and focuses her practice on Insurance Recovery. Liz has experience representing and advising corporate policyholders at various stages including risk management counseling, claims handling, and insurance coverage litigation. Liz has worked on coverage disputes under various types of insurance policies including commercial general liability, business income, directors and officers liability, fiduciary liability, and employment practices liability. Liz also collaborates with the firm’s global commercial disputes and financial industry groups, acting as an advocate for corporate clients in litigation and international arbitration. Liz works pro bono with the Commercial Law Development Program of the U.S. Department of Commerce conducting lectures and training seminars on international arbitration and international commercial law in the Middle East, North Africa, and the Balkan region.
