Overview

Everything was peaceful on Sunset Street until the new neighbor pulled into their driveway. Surveyors, landscapers, property engineers; all there to make life miserable. What are your rights and what can you do when you discover that the property line is not where you thought it was? This course will cover information regarding a variety of problematic issues that may arise within even the most peaceful of neighborhoods, residential, commercial, and industrial. This includes rights created by paper streets, rights created by abandoned rail lines, property lines changed by the movement of streams, claims relating to trees and other growing encroachments, claims related to inaccurate historic surveys.

Faculty

Erik M. Hume, Esq.

Mr. Hume is a Shareholder in the Harrisburg office of Saxton & Stump, a full-service Lancaster-based law firm. He is Chair of the firm’s Real Estate Group and a member of the Business and Corporate Law Group. In his practice, Mr. Hume advises clients through all aspects of real estate transactions and development. He represents landowners and developers in the sale, acquisition, leasing, financing, and development of commercial and residential real estate. His practice also includes the creation, development, and administration of commercial and residential condominiums and planned communities. In addition to his real estate practice, Mr. Hume also has significant experience in oil, gas, and mineral law matters and in commercial loan origination. He is a licensed title agent. Mr. Hume has presented several times on issues related to real estate law including easements, condominiums and planned communities, stormwater management, oil and gas law, and pipelines. He received his B.A. in Government from Lehigh University and his J.D. from the University of Pittsburgh School of Law. Mr. Hume served as a law clerk to the Hon. Michael A. Georgelis of the Lancaster County Court of Common Pleas.

James S. Tupitza, Esq.

Mr. Tupitza is a practicing attorney in West Chester under the firm name of Tupitza & Associates, PC. He practices primarily in the areas of real estate, business law and related litigation. Mr. Tupitza served as chair of the Real Estate Section of the Chester County Bar Association for many years. A frequent speaker and course planner for the Pennsylvania Bar Institute, and he has presented educational programs for various title insurance underwriters and real estate groups. Mr. Tupitza has authored materials on use of current technology, and chapters on real estate, deeds, boundary disputes, lien priority, riparian rights, realty transfer taxes, ethics, the drafting of legal descriptions, short sales, cost segregation studies, various title insurance matters, and real estate agent professional liability. He is admitted to practice before the U.S. Supreme Court and the U.S. Tax Court. Mr. Tupitza received his B.A. from Temple University, his J.D. from Widener University Delaware Law School and his LL.M. in Federal Taxation from Villanova University.
