Overview

Spousal lifetime access trusts (SLATs) are one of the most popular estate planning techniques for married couples. This session will review cases for SLATs ranging from basic to more complex estate planning approaches. In addition, this session will examine various provisions utilized within SLATs, will address the administrative strategies after SLATs have been fully funded, and will explore the pitfalls of using SLATs.

Faculty

Jeffrey C. Wolken, Esq.

Mr. Wolken is the National Director of Delaware Trust Strategies and a Senior Vice President at Wilmington Trust, N.A. in Wilmington, Delaware. He is responsible for developing trust planning strategies for wealthy individuals and families throughout the United States and abroad. Mr. Wolken works closely with his clients’ legal, tax, and investment advisors to construct and implement appropriate trust structures that take advantage of the state of Delaware’s unique trust and tax laws. Prior to joining Wilmington Trust in 2005, he spent seven years in private legal practice as a member of the estates and trusts practice group of the Philadelphia-headquartered law firm of Montgomery, McCracken, Walker Rhoads, LLP. Mr. Wolken earned his J.D., summa cum laude, and MBA, with honors, from Syracuse University and holds a bachelor’s degree in Economics from Northwestern University, where he was a member of Phi Beta Kappa. He is a frequent lecturer on topics involving the use of Delaware trusts for asset protection, state income tax minimization, and investment management for unique trust assets. Mr. Wolken is admitted to the practice of law in Delaware, Pennsylvania, and New Jersey. He is a member of the Estates and Trusts Section of the Delaware State Bar Association, and the Real Property, Probate and Trust Law section of the American Bar Association.

Marguerite C. Weese, Esq.

Marguerite serves as chief operating officer of Wilmington Trust Emerald Family Office & Advisory®, which provides a robust platform of strategic advisory services and solutions for successful executives, entrepreneurs, and their families. The Emerald team guides clients in the creation, implementation, and execution of complex financial, estate, and succession plans. In her role as national director of Family Legacy Strategies for Emerald, Marguerite is responsible for the development and delivery of strategic advice offerings that provide personal wealth planning to high-net-worth individuals and their families through the design and implementation of their estate, business succession, and family legacy plans. She oversees a national team of wealth planners, accountants, and family legacy advisors. Prior to joining Wilmington Trust, Marguerite was an associate in Pricewaterhouse-Coopers’ personal financial services group in their Philadelphia office. She holds a JD and master of laws (LL.M.) in taxation from Villanova University’s Charles Widger School of Law and earned her bachelor’s of science and bachelor’s of arts degrees from the University of Maryland, College Park. Marguerite has been recognized by the American Bankers Association as a member of the 40 Under 40 in Wealth Management, Class of 2021. She has been teaching estate planning at Philadelphia-area law schools and is currently an adjunct professor at Drexel University’s Klein School of Law. Marguerite currently sits on the executive committee of the Anti-Defamation League (ADL)’s Greater Philadelphia regional board and co-chairs their Diversity, Equity, Inclusion and Belonging committee.  She is an active member of the education committee, serving as co-chair for the 2023 Philadelphia Youth Leadership Conference Task Force. She previously served as vice chair of the board of directors for WOMEN’S WAY. Marguerite is the Philadelphia Bar Association’s Probate and Trust Section’s liaison to the Board of Governors. She has previously sat on the Probate Section’s Executive Committee and has co-chaired the section’s tax committee. 

Erin McQuiggan, Esq.

Erin E. McQuiggan is a partner in the Private Client Services practice group at Duane Morris LLP. Ms. McQuiggan advises private clients on trusts and estates law, focusing on comprehensive estate planning, probate and taxation matters. Her practice includes estate, gift and generation-skipping transfer tax planning, pre-transaction tax planning, closely held business planning (limited liability companies, limited partnerships and business succession planning), charitable planning and multi-generational wealth transfer planning. Ms. McQuiggan also counsels individual and corporate executors, trustees and families with respect to complex estate and trust administration. Ms. McQuiggan has broad experience in the preparation and funding of a wide variety of estate planning vehicles including wills, revocable trusts and irrevocable trusts, such as spousal lifetime access trusts, asset protection trusts, grantor retained annuity trusts, life insurance trusts and dynasty trusts. Ms. McQuiggan’s clients include wealth creators and business owners who have built success in private and public companies, including life sciences, technology and manufacturing. Her practice focuses on sophisticated pre- transaction planning around gift, estate and income taxes, and includes the preparation of gift, estate and inheritance tax returns. Ms. McQuiggan is well-versed in analyzing balance sheets, guiding the decision-making process and implementing holistic, thoughtful estate plans. She prides herself in distilling complex and confusing concepts into understandable language. Prior to entering private practice, Ms. McQuiggan served as law clerk to the Honorable Joseph D. O’Keefe, Administrative Judge of the Philadelphia Court of Common Pleas, Orphans’ Court Division. Ms. McQuiggan is a graduate of Temple University Beasley School of Law (LL.M. 2022), The State University of New York at Buffalo Law School (J.D. 2007) and The Pennsylvania State University (B.A. 2004).
