This session will provide an overview of several emerging environmental issues, discuss the potential impacts on real estate transactions, and identify strategies to reduce risk

Rights, Risks, and Remedies for Residential Construction Projects in Pennsylvania

This session will focus on residential construction and remodeling projects in Pennsylvania and will address the relationship between the owner and contractor. Topics will include contracting considerations on new residential construction and remodeling projects, performance, payment, warranties, latent deficiencies, and mechanic's lien considerations.

What's Up with Artificial Intelligence? – Ethics

This session will explore AI and its impact on real estate lawyers. The faculty will examine the PBA's ethics opinion on AI as well as examine some of the tools available to real estate lawyers to improve the efficiency of law practice. We will also discuss some of the AI tools being used by real estate professionals.

Faculty

Bryan P. Franey, Esq.

Mr. Franey is a partner at Manko, Gold, Katcher & Fox, LLP, an environmental and energy law firm located in Bala Cynwyd, PA. He has experience in counseling and representing clients on a range of environmental and energy matters. Over the last several years, Mr. Franey’s practice has focused on the environmental aspects of commercial transactions and brownfield development, regulatory compliance matters (particularly in the area of water quality, waste, and renewable fuels), environmental permitting, site remediation, sustainability, and renewable energy development. He received his B.S. in Integrated Science and Technology from James Madison University and his J.D. from Villanova Law School. Prior to law school, Mr. Franey worked as an energy consultant in Fairfax, Virginia, assisting industrial and commercial clients in optimizing energy supply sources, decreasing energy demand and implementing energy benchmarking. Mr. Franey has served as the co-chair of the Philadelphia Bar Association’s Environmental and Energy Law Committee and is a member of the Pennsylvania Bar Association, the Delaware Valley Environmental Inn of Court and Leadership Philadelphia Class of 2016. Mr. Franey previously served as an adjunct professor at Villanova University Charles Widger School of Law and is currently the Board Chair at Riverbend Environmental Education Center. He is admitted to practice in Pennsylvania and New Jersey.

Jonathan H. Spergel, Esq.

Jonathan H. Spergel, Esq. is a partner with Manko, Gold, Katcher & Fox LLP in Bala Cynwyd, Pennsylvania, the environmental and energy law firm with which he started his legal career in 1993. He served as the Managing Partner of the firm from 2014 to 2019.  Mr. Spergel handles a wide variety of environmental legal issues, including the environmental aspects of real estate and corporate transactions, brownfield redevelopments, environmental insurance procurement and coverage issues, public funding opportunities, and regulatory compliance counselling. From 2001 to 2003, he served as general counsel of large regional brownfields redevelopment company. He has authored numerous articles on environmental legal issues, and he frequently lectures for various groups and organizations. He graduated with distinction from Stanford University (1988) and received his J.D. from the University of Pennsylvania Law School, cum laude (1993). Mr. Spergel has also been an adjunct professor at Villanova University School of Law. Mr. Spergel currently serves as the Chair of the Board of Legacy Youth Tennis and Education (formerly Arthur Ashe Youth Tennis).  He is also the Chairman of the Board of the Montgomery County Redevelopment Authority, and he also serves on the Board of the City Avenue Special Services District.

Edward B. Gentilcore, Esq.

Mr. Gentilcore is a Senior Specialist Legal Editor, Real Estate (Construction) for Thomson Reuters’ Practical Law. Ed has been a frequent speaker at the Pennsylvania Bar Institute’s Day on Real Estate programs on a variety of topics of construction topics encountered in his 35-plus year career as a construction contracts attorney and litigator. Mr. Gentilcore has been both an outside counsel, recognized as Best Lawyers in America Construction Lawyer of the Year for the Pittsburgh Region in both 2014 and 2018 and Construction Litigation Lawyer of the Year for the Pittsburgh Region in 2016 and multiple years of recognition by both Best Lawyers of America and Super Lawyers, and in-house counsel, where Ed served as Deputy General Counsel and Chief Legal Officer in owner and design organizations. Mr. Gentilcore is Chair Emeritus of the Marketing Committee of the American Bar Association Forum on Construction Law and a former member of that organization’s Governing Committee. Ed obtained his undergraduate B.A. (cum laude) from the University of Pittsburgh and his J.D. (cum laude) from the University of Pittsburgh School of Law.

Daniel J. Siegel, Esq.

Attorney Daniel J. Siegel is a nationally recognized authority on ethics, technology, data protection and business workflow management, and the principal of both the Law Offices of Daniel J. Siegel, LLC and Integrated Technology Services, LLC. Dan provides techno-ethics counsel to solo, small and mid-sized law firms on cybersecurity, technology and other related issues. His practice includes representing of attorneys in disciplinary matters; providing professional responsibility guidance to attorneys and firms; serving as appellate counsel; and representing individuals in workers’ compensation and personal injury matters. Dan also consults with law firms and businesses on workflow management, implementation of paperless offices, and other productivity matters. Attorney Siegel is a prolific speaker and author, and serves as the Chair of the Pennsylvania Bar Association Committee on Legal Ethics and Professional Responsibility, and Past-Chair of the American Bar Association’s Professional Development Board Chair. The author of 15 books, Dan is a columnist and frequent lecturer on a wide range of topics, including ethics, technology, substantive law, appellate law, and professional responsibility matters. Jennifer L. Ellis, Esq.

Jennifer Ellis is a legal ethics attorney in Pennsylvania. She owns the consulting/law firm marketing company Jennifer Ellis, JD, LLC, through which she assists attorneys with issues such as electronic discovery, practice management, and online presence. Previously, Jennifer worked with a Philadelphia area personal injury firm, where she practiced legal ethics, managed the firm’s online presence, and oversaw its IT and security consultants. Jennifer also served as the Associate Director of Media Technology with the Pennsylvania Bar Institute, where she organized and presented courses on numerous issues, including law practice management, technology, and ethics.
