Representation & Drafting the Incapacity Petition

Attendees will learn about the representation of clients in guardianship cases including petitioners, interested parties, and the alleged incapacitated person. This session will explore the drafting of the emergency and permanent guardianship petitions and responsive pleadings, which have changed with the implementation of the new guardianship statute effective June 1, 2024. Attendees will gain valuable practice tips on drafting a proposed final decree that fits your case.

Chloe Mullen-Wilson, Esq.
Chloe Mullen-Wilson joined the Pile Law Firm in 2025 as a Senior Associate Attorney and focuses her practice on Orphans’ Court litigation, estate and trust administration, guardianships, special needs trusts, real estate and corporate matters. Chloe graduated from Seton Hall University, summa cum laude, where she majored in Spanish and History while minoring in Philosophy and Women’s Studies, and subsequently graduated from Temple University Beasley School of Law, cum laude. During law school, she clerked for the Honorable Petrese B. Tucker of the U.S. District Court for the Eastern District of Pennsylvania and for the Honorable Anne E. Lazarus of the Pennsylvania Superior Court. Chloe currently serves as the Chair of the Diversity Committee of the Probate and Trust Law Section of the Philadelphia Bar Association. In addition to being a member of the Philadelphia Bar Association, she is also a member of the Real Property, Probate and Trust Law Section of the Pennsylvania Bar Association, and the Probate and Tax Section of the Montgomery Bar Association.
Richard D. Magee, Jr., Esq.
Mr. Magee is a sole practitioner in Jamison, Pennsylvania. His practice emphasizes guardianship matters and includes estates and estate planning. He has represented families and institutions seeking emergency and permanent guardianship appointments in Bucks, Montgomery, Chester, Delaware, Philadelphia and Franklin counties. He has served as guardian or court-appointed counsel for alleged incapacitated persons in Bucks and Montgomery counties. Mr. Magee received his B.A. from Oberlin College in 1980 and J.D. from Duke University School of Law in 1983. He is a member of the Pennsylvania and Bucks County Bar Associations.
