This program is eligible for 1 hour of CLE credit in 60-minute states. In 50-minute states, this program is eligible for 1.2 hours of CLE credit. Credit hours are estimated and are subject to each state’s approval and credit rounding rules.
Overview
With the adoption of Act 61 in 2024, review hearings are expected to be scheduled in many more cases. This session will explore when such hearings may be required, the scope of the review that may be ordered, and what procedures and standards are applicable to review hearings. Appeals of orders in guardianship cases will be analyzed to assess which orders are appealable, what issues can and may be raised on appeal, the timing and timeliness of appeals, the parties to appeals, the applicable procedural rules that control appeals, and other practical issues facing counsel for the proposed appellant or appellee.

David A. Jaskowiak, Esq.
Mr. Jaskowiak is a sole practitioner in Jenkintown, PA, who has been in practice since 1987. He received a Bachelor of Arts from La Salle College (now, University) in 1977, graduating maxima cum laude. After several years working as a licensed real estate broker in the Commonwealth of Pennsylvania, he received his law degree from Temple University in 1987, graduating cum laude. His work in the area of elder law now focuses principally on litigation involving elder abuse, POA abuse and other financial exploitation issues, filial support, and guardianships. He has previously presented for the Pennsylvania Association of Elder Law Attorneys (“PAELA”), the Pennsylvania Bar Institute, the Montgomery County Bar Association, the Elder Roundtable for Justice, and both the Lehigh and Montgomery County Estate Planning Councils. He is admitted to practice in Pennsylvania, New Jersey, the United States District Courts for the Eastern and Middle Districts of Pennsylvania, and the Third Circuit.
Thomas J. Dempsey, Jr., Esq.
Mr. Dempsey is a Partner with the firm of Jones, Gregg, Creehan & Gerace, LLP in Pittsburgh. He graduated from the Duquesne University School of Law in 1987 and is a member of the Allegheny County and Pennsylvania Bar Associations. Mr. Dempsey’s practice is focused on litigation and appellate practice in the Orphans’ Court Division of Allegheny County and surrounding counties in the fields including guardianship, fiduciary defense and prosecution, and probate litigation. He is one of the founding members of the Allegheny County Bar Association Elder Law Committee. He is also a member of the Allegheny County Bar Association Probate and Trust Section Council. Mr. Dempsey regularly presents educational seminars on behalf of the Pennsylvania Bar Institute. He was recently appointed to a six-year term on the Supreme Court’s Appellate Court Procedural Rules Committee.
