Overview

Pay equity and pay transparency have moved to the center of employment compliance and the legal landscape is shifting rapidly. In the United States, the enforcement environment is being reshaped: federal OFCCP enforcement ended under Executive Order 14173 in January 2025 but has been replaced by False Claims Act exposure, the EEOC’s priorities are realigning (including the active pursuit of reverse-discrimination claims), state agencies are aggressively enforcing pay discrimination requirements, and private litigants have recovered nearly $250 million. This program is designed to help employers navigate these parallel developments and the heightened regulatory and litigation risk they create.

Attendees will gain practical, actionable guidance on:

  • Key pay equity trends shaping enforcement and litigation risk in the United States
  • Best practices for conducting privileged pay equity audits—including planning, team assembly, modeling decisions, grouping, and control factors—and why one audit is likely not enough
  • What employers should know now about evolving U.S. state pay transparency requirements, including state-specific nuances such as Colorado's unique rules and New Jersey's proposed pay-range limits
  • Practical strategies for communicating and implementing pay adjustments, centralizing compensation decisions, and maintaining good compensation practices to reduce transparency violations and pay equity lawsuits.

The overarching message is straightforward: ignorance is not bliss. With employees now able to access pay data in unprecedented ways, and with the burden of proof on employers to show that pay differences are justified by objective criteria, proactive and privileged preparation is the most effective way to manage compensation decisions in this heightened regulatory environment.

Kristi S. Nelson Foy, Esq.

Kristi Nelson Foy is a pragmatic, strategic partner to employers, offering experienced counsel and direction across a wide variety of labor and employment matters. Over the course of her career, Kristi has developed extensive experience in advising employers on designing and implementing compensation strategies that ensure compliance with evolving legal standards and promote fairness and transparency in compensation practices. Her work in this area includes counseling on pay transparency compliance, conducting pay audits, and developing policies and practices to prevent pay disparities. Kristi’s commitment to advancing pay equity has been recognized with her appointment as co-chair of Ogletree’s national Pay Equity Practice Group. In addition to her work in pay equity, Kristi has become a formidable advocate in contested cases. She has litigated employment claims before state and federal administrative agencies, state and federal courts, and the U.S. Department of Education’s Office of Civil Rights. Kristi has adeptly represented clients in internal investigations, employee grievance processes, mediations, and arbitrations. She has also served as lead negotiator in dozens of bargaining scenarios. Additionally, Kristi spent several years as both an in-house attorney and Director of Human Resources for public sector entities. In these executive leadership roles, she managed hundreds of employees and a multimillion-dollar salary and benefits budget. Kristi was directly responsible for strategic staffing decisions, expanding and enhancing employee benefit opportunities, administering leave provisions, implementing new policies and training requirements, managing employee performance, and making all disciplinary and termination decisions. This first-hand experience has given her unique insight into the challenges faced by human resources professionals and business owners nationwide. The perspective Kristi gained in-house enables her to provide relevant and discerning advice and counsel. Kristi’s comprehensive understanding of labor and employment law, combined with her practical experience in human resources management and executive leadership, makes her an invaluable asset to any organization navigating the complexities of the modern workplace.

Jennifer L. Pacicco, Esq.

Jennifer is an associate in the firm’s Philadelphia office. She focuses her practice on employment litigation and counseling, including defending discrimination and harassment claims. Prior to joining Ogletree, Jennifer served as a law clerk for the Honorable Joel H. Slomsky in the United States District Court in the Eastern District of Pennsylvania. Jennifer received her J.D. from Villanova University Charles Widger School of Law, cum laude. During law school, she served as a judicial intern for the Honorable Lois H. Goodman in the United States District Court for the District of New Jersey and as a judicial extern for the Honorable Cheryl Ann Krause in the United States Court of Appeals for the Third Circuit. She also worked as a Student Works Editor for the Villanova Law Review and was a member of the Public Interest Scholar’s Program. She is a member of the Justinian Society and the National Association of Italian-American Women.
