A Case That Captivated the Nation

One of the most talked-about criminal cases in the country takes center stage in this fascinating ethics-focused webcast. In the early morning hours of January 29, 2022, after a night out at several bars during a Boston snowstorm, Karen Read and her boyfriend, Boston Police Officer John O’Keefe, arrived at the home of fellow officer Brian Albert. O’Keefe exited the vehicle — and was never seen alive again.

Competing Narratives and Mounting Controversy

Karen Read later returned to the residence after O’Keefe failed to come home and discovered his body in the snow. Prosecutors charged Read with second-degree murder and manslaughter, alleging she struck O’Keefe with her vehicle. The defense countered with explosive allegations of police bias, a flawed investigation, and a cover-up involving law enforcement officers inside the home. The controversy deepened when lead investigator Trooper Michael Proctor was fired over inappropriate text messages regarding Read.

Using this nationally followed case as a backdrop, this program examines the ethical obligations of prosecutors under Rule of Professional Conduct 3.8, including the duty to disclose favorable evidence to the defense and the constitutional requirements established under Brady v. Maryland. Participants will explore when police officer bias, misconduct, or prior bad acts must be disclosed and analyze real-world examples of Brady material involving law enforcement credibility issues.

Philip Bogdanoff, Esq.

Philip Bogdanoff is a nationally recognized continuing legal education speaker and a trained educator. Previously, he served as an assistant prosecutor in the Summit County Prosecutor’s Office for over 25 years. Mr. Bogdanoff argued cases before the Ohio Ninth District Court of Appeals and over twenty cases before the Ohio Supreme Court including six death penalty cases – before retiring as a senior assistant prosecutor. He currently serves as a special prosecutor in Ohio arguing cases before the Ohio Supreme Court and various appellate courts. He has done presentations on ethics and professionalism for approximately fifty organizations including the National District Attorneys Association, National Association of Legal Administrators, state and local bar associations and prosecuting attorney’s associations.
