Overview
Every lawyer with a busy practice will likely face an unpleasant accusation of improper ethical conduct over the course of the lawyer's decades of practice. Claude Ducloux has handled 100s of such matters across the country. He prepared this course to inform lawyers of the best way to approach the issue, prepare a response, and move forward. We will start with an analysis of the most common grievances and daily practices to avoid those situations. We will talk client relations, the importance of securing reasonable expectations with the client, and ongoing communication skills. Next we will discuss the typical parameters of a complaint and a proven methodology to prepare a response. We will also discuss those times when a lawyer acknowledges some potential liability for the conduct, and how to "get ahead" in the process of resolving it prior to a first response. This course is fast-paced, entertaining, enlightening, and a must-see for any busy practitioner.

Claude E. Ducloux, Esq.
Claude E. Ducloux has been licensed in Texas since 1977 and has also been licensed in California and Colorado. In 2011, he won the highest statewide award from the State Bar of Texas for lifetime contribution to CLE (the Gene Cavin Award). He has spoken at more than 800 programs throughout the United States since January 1, 2016, where attendees regularly rate his presentations very highly. Mr. Ducloux has a long legacy of bar service, including service as president of the Austin Bar Association, chair of the Texas Bar Foundation, and service as chair of many other bar-related entities. He is Board-Certified in Civil Trial Law and Civil Appellate Law by the Texas Board of Legal Specialization, and is the former chair of the Texas Center for Legal Ethics. He retired May 31, 2025, as the National Director of Education, Ethics, and State Compliance for Affinipay-LawPay. During his career, he has been honored with numerous awards for writing, pro bono service, and contributions to the law in the field of litigation. As of January 1, 2025, more than 132 of his articles on the practice of law have been published in bar journals and legal media.
