Faced with the risk of losing the surrender, a senior prosecutor made a split-second decision that would stun the legal community: he impersonated defense counsel to bring in the killer. This true-crime-meets-legal-ethics CLE asks the question every lawyer should wrestle with: If it works—and people are safer—does that make it ethical? Using real disciplinary cases and cinematic film clips, we examine when deception becomes misconduct, why good intentions don’t immunize lawyers from discipline, and how easily “doing the right thing” can violate the Rules of Professional Conduct. The program takes a hard look at Rule 8.4 (Misconduct), Rule 3.3 (Candor Toward the Tribunal), and Rule 5.3 (Responsibilities Regarding Nonlawyer Assistants)—and challenges attendees to decide where they would draw the line.

Philip Bogdanoff, Esq.

Philip Bogdanoff is a nationally recognized continuing legal education speaker and a trained educator. Previously, he served as an assistant prosecutor in the Summit County Prosecutor’s Office for over 25 years. Mr. Bogdanoff argued cases before the Ohio Ninth District Court of Appeals and over twenty cases before the Ohio Supreme Court including six death penalty cases – before retiring as a senior assistant prosecutor. He currently serves as a special prosecutor in Ohio arguing cases before the Ohio Supreme Court and various appellate courts. He has done presentations on ethics and professionalism for approximately fifty organizations including the National District Attorneys Association, National Association of Legal Administrators, state and local bar associations and prosecuting attorney’s associations.
