Overview

Eminent Domain is one of the most polarizing subjects in Pennsylvania law. Our state and local governments, public utilities and railroads often rely upon their eminent domain power to acquire lands needed for public improvements. Similarly, landowners and tenants are often upset by these entities’ abilities to take private land, even with just compensation.  In this basic course, we will discuss the procedures for condemning land under the Pennsylvania Eminent Domain, the defenses available to condemnees, the damages to which condemnees are entitled, and the proper means of calculating these damages.
