Overview

The COVID-19 Pandemic has changed, perhaps permanently, the world in which we live.  Just as all other sectors of the economy have been forced to adapt to never-before seen restrictions, safety protocols and precautions, the legal industry has found itself faced with many new challenges ranging from closed courthouses to remote depositions.  However, no part of the legal industry has seen as much turmoil and confusion as the landlord/tenant realm.   Eviction moratoriums were enacted on the state and federal levels, expired, renewed by government and the courts, and then taken away again.  As a result, landlords and tenants alike have been left confused as to their respective rights, duties and obligations when it comes to evictions, all of which are subject to change with little or no notice.  This course will discuss the current state of residential evictions in Pennsylvania, as well as what landlords and tenants can expect as we hopefully move forward and out of this pandemic.

Faculty

Andrew M. Menchyk, Jr., Esq.

Mr. Menchyk has been a member of Stepanian & Menchyk LLP since 2003 and has been a partner since 2009. He has experience in all of the firm’s practice areas and focuses on municipal, land development, real estate, construction, corporate, and employment law. Mr. Menchyk is a member of the Butler County Bar Association and the Pennsylvania Bar Association. He is admitted to practice before the Supreme Court of Pennsylvania and the United States District Court for the Western District of Pennsylvania. Over the course of his career, Mr. Menchyk has represented clients in the Pennsylvania Courts of Common Pleas throughout Pennsylvania in jury and non-jury trial proceedings as well as numerous arbitration proceedings. He has handled matters in other forums including the United States District Court for the Western District of Pennsylvania, the United States Bankruptcy Court for the Western District of Pennsylvania, Pennsylvania Public Utilities Commission, Pennsylvania Bureau of Worker’s Compensation, and Pennsylvania Bureau of Unemployment Compensation. Mr. Menchyk was born and raised in Butler and graduated from Butler High School in 1993. He then attended the University of West Virginia where he graduated with a Bachelor of Arts Degree in Political Science in 1997. After graduation, Mr. Menchyk attended the University of Pittsburgh School of Law and earned his law degree in 2000. Prior to joining Stepanian & Menchyk, Mr. Menchyk practiced as an associate attorney at a Pittsburgh law firm where he focused his practice on real estate and general business law. In 2010-2011, 2013-2014 Mr. Menchyk was recognized by Pennsylvania Super Lawyers Magazine as a Pennsylvania Super Lawyer “Rising Star” in the area of real estate. In 2021 Mr. Menchyk was recognized by Pennsylvania Lawyers Magazine as a Pennsylvania Super Lawyer.  Mr. Menchyk currently represents approximately 15 municipalities and authorities, including two county housing authorities.

Frank Kosir, Jr., Esq.

Frank Kosir, Jr., is a partner with Meyer, Unkovic & Scott LLP in Pittsburgh, Pennsylvania, and is a member of the firm’s Real Estate and Lending, Litigation and Dispute Resolution, Construction Law, and Energy and Mineral Rights Groups. He has significant civil litigation and general practice experience in all areas of real property law, and acquired extensive experience in all facets of real estate development, sales, construction, and leasing prior to entering the practice of law. Mr. Kosir represents clients in a wide range of matters including commercial and residential real estate tax assessment appeals, commercial and residential sales and leasing, oil and gas lease negotiations, title defense, commercial and residential landlord-tenant proceedings, and zoning and land use issues. He is a frequent lecturer at continuing legal education programs. Mr. Kosir was recognized five times as a Pennsylvania Super Lawyers® Rising Star® in real property law, and has been recognized five times as Pennsylvania Super Lawyers® Super Lawyer. Mr. Kosir has also twice been recognized in Best Lawyers in America. He is a member of the Pennsylvania Bar Association, the Allegheny County Bar Association, and the Washington County Bar Association. Mr. Kosir received his B.A. from Washington & Jefferson College in 1998, and his J.D. from the Duquesne University School of Law in 2001. He resides in Peters Township, Pennsylvania, where he formerly served as a member of the Township Planning Commission and is now in his ninth year as an elected Township Councilman.
