This 1-hour session will examine a false adverting case study and guide you through understanding how presumptions can simplify the case; how to use discovery to lock down simplified elements to position case for summary judgment/mediation and how to determine whether insurance coverage is available AND the impact an “intentional act” may have on it . In addition, the Lanham Act, the New Jersey Consumer Fraud Act (“CFA”) and the Pennsylvania’s Unfair Trade Practices and Consumer Protection Law (“UTPCPL”) will be discussed.
