Session 1: When the ABA Speaks, Should You Listen?
The American Bar Association Standing Committee on Ethics and Professional Responsibility interprets the Model Rules of Professional Conduct. Because Pennsylvania is a “Model Rules” jurisdiction, the Committee’s interpretation of the Rules matters carries weight in our courts and with the Disciplinary Board and the Supreme Court. This year the Committee issued five opinions, ranging from an esoteric discussion of choice of law in disciplinary matters to a primer on the right way to prep a witness. Our panelists will summarize the opinions and their applicable advice, discuss their helpfulness (or lack thereof) and predict what they portend for the future of disciplinary enforcement. 

Session 2: Pitfalls, Problems and Questions: A Practical Primer for Minding Your Ps and Qs!
As Respondent’s counsel, our panelists see the gamut of the type of mistakes and misconduct that regularly lead to trouble. The panel will review these easy-to-avoid issues and provide practice pointers on how to avoid red flags in your practice and how to minimize your risk when things go wrong. 

Session 3: 2023 Attorney Disciplinary Round-up and 2024 Predictions
Our panelists will discuss the key disciplinary cases and trends in 2023 and predict some interesting developments they see coming in 2024. Learn about what went right and what went wrong in the disciplinary process in 2023, Rule changes, and what it all means for your practice and the profession.
